ORDINANCE NO. 1634
AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE
CITY OF CALDWELL, IDAHO, FROM R -1 LOW DENSITY RESIDENTIAL TO R -3
MULTI- FAMILY HIGH DENSITY RESIDENTIAL AND DETERMINING THAT SAID
CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL,
IDAHO: REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT
HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALD-
WELL, IDAHO:
WHEREAS, It has been determined by the City Council of the
City of Caldwell, Idaho, upon recommendation of the Planning and
Zoning Commission of the City of Caldwell, Idaho, and following
the public hearing procedures as required, that it is in the best
interests of the City of Caldwell, Idaho, that certain property
described hereafter as Exhibit A be rezoned, it is hereby ordained
as follows:
Section 1. That certain land described in Exhibit "A"
attached hereto, and by this reference incorporated herein, is
now zoned R -1 Low Density Residential, and is located within the
City of Caldwell, Canyon County, State of Idaho, the Council hav-
ing previously annexed said land to the City of Caldwell, Idaho.
Section 2. It is hereby declared by the Mayor and Council
of the City of Caldwell, Idaho, that the tract of land described
in Exhibit "A," a proper legal description, to be declared to be
R -3 Multi- Family High Density Residential, and shall be so changed
from R -1 Low Density Residential to R -3 Multi - Family High Density
Residential after the date of this Ordinance.
Section 3. The City Clerk of the City of Caldwell and the
City Engineer of the City of Caldwell are hereby instructed to so
designate the same above - described property on the official zoning
map of the City of Caldwell, Idaho, as being R -3 Multi- Family High
Density Residential property.
Section 4. All ordinances, resolutions, orders or parts
thereof in conflict herewith are hereby repealed, rescinded and
annulled.
ORDINANCE - 1
Section 5. This ordinance shall be in full force and effect
from and after its passage, approval and publication according to
law.
PASSED BY THE CITY COUNCIL of the City of Caldwell this
21st day of D ecember , 1982.
APPROVED BY THE MAYOR of the City of Caldwell this 21st
day of December , 1982.

EXHIBIT A
That part of the Northeast Quarter of the Northwest Quarter of
the Southeast Quarter of Section 28, Township 4 North, Range 3
West of the Boise Meridian, in the City of Caldwell, Canyon County,
Idaho, described as follows:
BEGINNING at the Northeast corner of the Northwest Quarter of the
Southeast Quarter of Section 23, Township 4 North, Range 3 West
of the Boise Meridian; thence South along the East line thereof,
100 feet; thence West, parallel with the North line of said North-
west Quarter of the Southeast Quarter, a distance of 165 feet;
thence North and parallel with the East line of said Northwest
Quarter of the Southeast Quarter, 100 feet to a point in the North
line thereof; thence East along said North line, 165 feet to the
POINT OF BEGINNING.
This property is located at 1702 S. Kimball Avenue at the South-
west corner of the intersection of Logan Street and Kimball Avenue.
