AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPROPRIATE,
NOTICE THEREFOR WAS GIVEN: DETERMINING THAT VACATION OF THE FOLLOW -
ING DESCRIBED REAL PROPERTY SHALL BE MADE, TO -WIT:
That portion of Rim View Drive lying west of Rice Avenue as
shown on the official plat of Monte Vista Addition to Caldwell,
Idaho, on file and of record in the office of the Recorder of
Canyon County, Idaho, more particularly described in Exhibit
A attached; AND THAT IT
IS Iii THE BEST PUBLIC INTEREST FOR THE CITY OF CALDWELL, IDAHO;
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
Section 1. That by a Motion passed and approved by the Mayor
of the City of Caldwell, Idaho, on the 25th of May, 1932, and sta-
tutory notice having been given to citizens and owners of property
in the City of Caldwell, Idaho, that an application has been presented
to the Mayor and Council of the City of Caldwell, Idaho, requesting
passage and approval of an ordinance vacating the above - described
real property located in Caldwell, Canyon County, Idaho, subject to
the reservations of all utility companies and all existing easement
rights in the area comprising easement rights for sewer lines, water
lines, power lines, telephone lines and gas lines as presently located
thereon or therein, with the further reservation to the City of Cald-
well, if applicable, and all utility companies with easement rights
in the area comprising said easement rights for access to and from
said area to maintain, repair, or replace the present existing sewer,
water, power, telephone and gas lines as presently located thereon
or therein.
Section 2. That it is hereby determined that it is in the best
public interest that the above - described premises in the City of
Caldwell, Canyon County, Idaho, be vacated, subject to existing ease-
ment rights and further easement rights as hereinabove set forth.
Section 3. Be it ordained and established that the above -des-
cribed premises in the City of Caldwell, Canyon County, Idaho, as
more particularly described in Exhibit A attached, shall be vacated
and shall no longer be open or subject to the use of the public

and thereupon title to said premises in the City of Caldwell, Canyon
County, Idaho, above- described, shall pass and revert to the persons
dedicating the same or their successors, heirs, and assigns, subject
to existing easements in the area comprising easements for sewer lines,
water lines, power lines, telephone lines and gas lines as presently
located thereon or therein, with the further reservation to all utility
companies with easement rights in the area for access to and from said
area to maintain, repair or replace the present existing sewer, water,
power, telephone lines and gas lines as presently located thereon or
therein, with the further reservation to all utility companies with
easement rights in the area for access to and from said area to main-
tain, repair or replace the present existing sewer, water, power,
telephone and gas lines as presently located thereon or therein.
The above - described premises shall be vacated and shall pass and
revert to the persons dedicating the same, or their successors,
heirs and assigns in the manner in which they were so dedicated.
PASSED BY THE COUNCIL of the City of Caldwell this 15t _ day

EXHIBIT A
A portion of Rim View Drive and a portion of Monte Vista Drive
adjoining Block 4 of the Monte Vista Addition to Caldwell, lying
in the North Half of Section 15, Township 4 North, Range 3 West
of the Boise Meridian, in Canyon County, Idaho, more particularly
described to wit:
COMMENCING at the Northwest Corner of Lot 1, Block 4 of the Monte
Vista Addition to Caldwell, Canyon County, Idaho, the INITIAL
POINT of this description; thence South 0 0 00' East, 211.30 feet
along the West line of Lots 1 and 2 in said Block 4, to the South-
west corner of said Lot 2; thence meandering along the Westerly
boundary of Lot 3 in said Block 4, South 17 0 06' East, 68 feet;
thence South 37 0 53' East, 94.46 feet (formerly of record 94.5 feet)
to a point on the South line of said Block 4; thence North 89 0 40'
East, 177 feet to the Southeast corner of said Block 4; thence South
0 0 00' East, 50 feet; thence South 89 0 40' West, 176.59 feet; thence
North 52 0 10' West, 79.52 feet; thence North 37 0 53' West, 66.28 feet;
thence North 17 0 06 West, 84.68 feet, to a point on the West boundary
of said Monte Vista Addition; thence North 0 0 00' East, 218.53 feet
to the Northwest corner of said Monte Vista Addition; thence North
89 0 40' East, 50 feet along the North boundary of said Monte Vista
Addition to the INITIAL POINT of this description.
