HomeMy WebLinkAboutORD 16220 BILL NO. 10 ORDINANCE NO. 1622 r f AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO, FROM R -3T HIGH DENSITY RESIDENTIAL TO C -2 COM- MUNITY COMMERCIAL AND DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon recommendation of the Planning and Zoning Commission of the City of Caldwell, Idaho, and following the public hearing procedures as required, that it is in the best interests of the City of Caldwell, Idaho, that certain property described here- after as Exhibit A be rezoned, it is hereby ordained as follows: Section 1. That certain land described in Exhibit "A" attached hereto, and by this reference incorporated herein, is now zoned R -3T High Density Residential with a T Mobile Home Individual Overlay and is located within the City of Caldwell, Canyon County, State of Idaho, the Council having previously annexed said land to the City of Caldwell, Idaho. Section 2. It is hereby declared by the Mayor and Council of the City of Caldwell, Idaho, that the tract of land described in Exhibit A, a proper legal description, to be declared to be C -2 Community Commercial and shall be so changed from R -3T to C -2 after the date of this ordinance. Section 3• The City Clerk of the City of Caldwell and the City Engineer of the City of Caldwell are hereby instructed to so designate the same above - described property on the official zoning map of the City of Caldwell as being C -2 Community Commercial property. Section 4. All ordinances, resolutions, order, or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. ATTEST: City Cler ORDINANCE - 2 L EXHIBIT A • BEGINNING at a point which is the intersection of the centerline of Albany Street with the centerline of 12th Avenue as shown on the of- ficial plat of CALDWELL, IDAHO, on file and of record in the office of the Recorder of Canyon County, Idaho; thence Southeasterly along the centerline of Albany Street, 90 feet to the Southeasterly line extended of Lot 2, Block 85 of said plat of Caldwell, Idaho; thence Southwesterly along the Southeasterly line and the Southeasterly line extended of said Lot 2 to the centerline of the Oregon Short Line Railroad right -of -way; thence Northwesterly along the center- line of the Oregon Short Line Railroad right -of -way, 90 feet to its intersection with the centerline of 12th Avenue; thence Northeasterly along the centerline of 12th Avenue to its intersection with the centerline of Albany Street, which is the POINT OF BEGINNING.
