ORDINANCE NO. 1621
AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY
OF CALDWELL, IDAHO, FROM R3T HIGH DENSITY RESIDENTIAL (MOBILE HOME
INDIVIDUAL OVERLAY) TO C -4T INTERCHANGE OR FREEWAY COMMERCIAL (MOBILE
HOME INDIVIDUAL OVERLAY) AND DETERMINING THAT SAID CHANGE IN ZONING
IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO; REPEALING
ALL LAWS, ORDINANCES AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
WHEREAS, it has been determined by the City Council of the City
of Caldwell, Idaho, upon recommendation of the Planning and Zoning
Commission of the City of Caldwell, Idaho, and following the public
hearing procedures as required, that it is in the best interests of
the City of Caldwell, Idaho, that certain property described here-
after as Exhibit A be rezoned, it is hereby ordained as follows:
Section 1. That certain land described in Exhibit A attached
hereto, and by this reference incorporated herein, is now zoned
R -3T High Density Residential with a T Mobile Home Individual Over-
lay and is located within the City of Caldwell, Canyon County, State
of Idaho, the Council having previously annexed said land to the
City of Caldwell, Idaho.
Section 2. It is hereby declared by the Mayor and Council of
the City of Caldwell, Idaho, that the tract of land described in
Exhibit A, a proper legal description, to be declared to be C -4T
Interchange or Freeway Commercial with a T Mobile Home Individual
Overlay and shall be so changed from R -3T to C -4T after the date of
this ordinance.
Section 3. The City Clerk of the City of Caldwell and the City
Engineer of the City of Caldwell are hereby instructed to so designate
the same above - described property on the official zoning map of the
City of Caldwell as being C -4T Interchange or Freeway Commercial prop-
erty.
Section 4. All ordinances, resolutions, order, or parts thereof
in conflict herewith are hereby repealed, rescinded and annulled.
Section 5. This ordinance shall be in full force and effect
from and after its passage, approval and publication according to law.

EXHIBIT A
Beginning at the point of intersection of the centerline of N. Illi-
nois Avenue with the centerline of Joliet Street in the City of
Caldwell, Idaho; thence Southeasterly along the centerline of Joliet
Street to the Northeasterly boundary of the right -of -way for vacated
10th Avenue; thence Southwesterly along the said right -of -way line
and the Southwesterly lot line of Lot 12, Block 60, Dever's Addition,
the official plat of which is on file and of record in the office of
the Recorder of Canyon County, Idaho, to Idaho State Highway I -84
right -of -way; thence westerly along State Highway right -of -way fol-
lowing the arc of a curve having a radius of 366 feet to the South
corner of Lot 13, Block 67 of said Dever's Addition; thence North-
westerly along the Southwesterly boundary and the Southwesterly
boundary extended of said Block 67 to the centerline of N. Illinois
Avenue; thence North along the centerline of N. Illinois Avenue to
the Point of Beginning.
