AN ORDINANCE OF THE CITY OF CALDWELL, IDAHO, CREATING A NEW SECTION,
TITLE II, CHAPTER 10; SECTIONS 2 -10 -1 THROUGH 2 -10 -6, IN REGARDS TO
THE YOUNG ADULT ADVISORY COMMISSION, SETTING FORTH THE LIMITATION ON
POWERS OF THE COMMISSION, SETTING FORTH THE MEMBERS OF THE COMMISSION,
SETTING FORTH THE MEETINGS, MEMBERS, AND PROCEDURES OF THE COMMISSION;
AND PROVIDING FOR THE CONFIDENTIALITY OF ALL DATA.
2 -10 -1 CREATION OF COMMISSION
There is hereby created a Young Adult Advisory Commission whose
duties shall be to advise the Mayor and Council on all youth matters
referred to it by them, to evaluate and coordinate the human and
physical resources of the City which may be utilized to reduce juvenile
delinquency and to develop youth resources for community service. In
order to carry out their duties, the Commission shall have broad powers
to establish its procedures, projects, and programs.
2 -10 -2 POWERS AND DUTIES
The Young Adult Advisory Commission shall:
(a) Provide such youth services as necessary to provide a
focus of information and action for all public and private agencies
dealing with troubled or delinquent youth;
(b) Work closely with all County and State agencies in the
rehabilitation, treatment, protection, and enhancement of the welfare
of the children under eighteen (18) years of age, who reside in the City;
(c) Provide counseling service for youths referred to the
Commission by County officers or agencies, or by parents or legal
guardians of such youths;
(d) Enter proceedings at the request of any County or State
Court, or the parents or guardians of such youths;
(e) Study and establish such local preventive programs as
the Commission deems advisable, feasible, necessary or beneficial. The
Commission shall suggest the use of professional services to the family
of such youth before application of police or Court action.
2 -10 -3: LI MITATION OF POWERS
The Commission or any of its members acting in the name of the
Commission or on behalf of the City shall not have:
(a) Arret or detention powers;
(b) Power to conduct trial proceedings, issue summons, or to
perform any powers delegated to the police by statute or
ordinance;
(c) Power to enforce City ordinances.
2 - 10 - 4 : MEMBERSHIP
The Young Adult Advisory Commission shall be composed of
nine (9) members. Representation on the Commission shall be appointed
from within or outside the Community as needed to fulfill purpose.
Of the members first
appointed, four (4) shall hold office for a term of one (1) year; four
(4) for a term of two (2) years, and one (1) for a term of three (3)
years. Their successors shall be appointed for a term of two (2) years
from and after the expiration of the terms of their predecessors in
office. If a vacancy shall occur, otherwise than by expiration of a term,
it shall be filled by the Mayor and Council by appointment for the
unexpired term.
The Commission shall meet as needed.
Special meetings shall be held at
the call of the Chairman or at the request of any three (3) members.
2 - 10 - 5 : AGREEMENTS WITH OTHER OFFICIALS AND AGENCIES
The Commission shall establish such liaison and working agreements
with federal, state, county or municipal agencies as may be necessary
to carry out its duties, provided, however, that such agreements shall
be first approved by the Mayor and Council.
2 -10 -6: D ATA TO BE CONFIDENTIAL
The Commission shall maintain the confidentiality of case history
data which it accumulates. Such data shall not be opened to public
inspection.
