HomeMy WebLinkAboutORD 16071 BILL NO. 17 ORDINANCE NO. 1607 AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO, FROM R -2 MEDIUM DENSITY RESIDENTIAL ZONE TO C -1 NEIGHBORHOOD COMMERCIAL ZONE AND DETERMING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO: REPEALING ALL LAWS, ORDINANCES, AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: WHEREAS, It has been determined by the City Council of the City of Caldwell, Idaho, upon recommendation of the Planning and Zoning Commission of the City of Caldwell, Idaho, that it is in the best interests of the City of Caldwell, Idaho, that certain property described hereafter be rezoned, it is hereby ordained as follows: Section 1. That certain land described in Exhibit " A " attached hereto, and by this reference incorporated herein, is now zoned R -2 Medium Density Residential Zone, and is located within the City of Caldwell, Canyon County, State of Idaho, the Council having previously annexed said land to the City of Caldwell, Idaho. Section 2. It is hereby declared by the Mayor and Council of the City of Caldwell, Idaho, that the tract of land described in I Exhibit "A ", a proper legal description, to be declared to be C -1 Neighborhood Commercial Zone, and shall be so changed from R -2 Medium Density Residential Zone to C -1 Neighborhood Commercial Zone after the date of this ordinance. Section 3. The City Clerk of the City of Caldwell, and the City Engineer of the City of Caldwell, are hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho, as being C -1 Neighborhood Commercial Zone property. Section 4. All ordinances, resolutions, order, or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and effect ORDINANCE - 1 0 fl from and after its passage, approval and publication according to law. PASSED BY THE CITY COUNCIL of the City of Caldwell this 4th day of August , 1981. APPROVED BY THE MAYOR of the City of Caldwell this day of August , 1981. ATTEST: City Cler 4th ORDINANCE - 2 • EXHIBIT A BEGINNING at the Northeast corner of Section 34, Township 4 North, Range 3 West of the Boise Meridian, which point is the intersec- tion of the centerline of Linden Street with the centerline of Indiana Avenue; thence South along the centerline of Indiana Avenue, 162.65 feet; thence West and parallel with the North boundary of Section 34, 196.15 feet; thence North and parallel with the East boundary of 34, 162.65 feet to the centerline of Linden Street; thence East along; the centerline of Linden Street, 196.15 feet to the POINT OF BEGINNING. This property is known as 2022 E. Linden Street and is located in Tract A of Mountain View Subdivision to Caldwell, Idaho.
