ORDINANCE NO. 1602
AN ORDINANCE TO AMEND TITLE IX, CHAPTER 10, OF THE MUNICIPAL CODE OF
THE CITY OF CALDWELL, STATE OF IDAHO, RELATING TO FIREWORKS BY CHANGING
CERTAIN LANGUAGE IN SECTION 9, TIME OF APPLICATION; AND SECTION 11,
TIME OF SALE; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDER OR PARTS
HEREOF IN CONFLICT HEREWITH AND PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Section 9, Chapter 10, Title IX of the Municipal
Code of the City of Caldwell be amended as follows:
9 -10 -9: TIME OF APPLICATION: Each application for a permit to
sell "safe" fireworks at retail shall be filed with the City Clerk on or
before April -I May 1 of the calendar year for which the permit is
sought, exeept - that -fer- the- ealendar- year -cf- 1967;- applieatiens - for
a- permit- may -be- filed- ea -er -before- June -l -1967. Variances may be
granted to said filing date under extenuating circumstances subject to
two - thirds (2/3) vote of the City Council.
Section 2. That Section 11, Chapter 10, Title IX of the Municipal
Code of the City of Caldwell be amended as follows:
9- 10 -11: TIME OF SALE: No "safe" fireworks shall be sold or
offered for sale except from twelve o'clock (12:00) noon on the fifteenth
day - of -June twenty - eighth day of June to midnight on the fifth day of
July of each year.
Section 3. That all ordinances or parts of ordinances inconsistent
herewith are hereby repealed.
Section 4. This ordinance shall be in full force and effect from
and after its passage, approval and publication according to law.
PASSED BY THE CITY COUNCIL of the City of Caldwell, Idaho, this
7th day of July , 1981.
