HomeMy WebLinkAboutORD 1598BILL NO. 8 49 ORDINANCE NO. 1598 AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO, FROM R -1 LOW DENSITY RESIDENTIAL ZONE TO R -3 MULTI- FAMILY HIGH DENSITY RESIDENTIAL ZONE AND DETERMING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO: REPEALING ALL LAWS, ORDINANCES, AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: WHEREAS, It has been determined by the City Council of the City of Caldwell, Idaho, upon recommendation of the Planning and Zoning Commission of the City of Caldwell, Idaho, that it is in the best interests of the City of Caldwell, Idaho, that certain property described hereafter be rezoned, it is hereby ordained as follows: Section 1. That certain land described in Exhibit " A " attached hereto, and by this reference incorporated herein, is now zoned R -1 Low Density Residential Zone, and is located within the City of Caldwell, Canyon County, State of Idaho, the Council having previously annexed said land to the City of Caldwell, Idaho. Section 2. It is hereby declared by the Mayor and Council of the City of Caldwell, Idaho, that the tract of land described in Exhibit "A ", a proper legal description, to be declared to be R -3 Multi- Family High Density Residential Zone, and shall be so changed from R -1 Low Density Residential Zone to R -3 Multi- Family High Density Residential Zone after the date of this Ordinance. Section 3. The City Clerk of the City of Caldwell, and the City Engineer of the City of Caldwell, are hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho, as being R -3 Multi- Family High Density Residential Zone property. Section 4. All ordinances, resolutions, order, or parts ORDINANCE - 1 thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law.
