ORDINANCE NO. 1598
AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY
OF CALDWELL, IDAHO, FROM R -1 LOW DENSITY RESIDENTIAL ZONE TO R -3 MULTI-
FAMILY HIGH DENSITY RESIDENTIAL ZONE AND DETERMING THAT SAID CHANGE IN
ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO: REPEALING
ALL LAWS, ORDINANCES, AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
WHEREAS, It has been determined by the City Council of the City
of Caldwell, Idaho, upon recommendation of the Planning and Zoning
Commission of the City of Caldwell, Idaho, that it is in the best
interests of the City of Caldwell, Idaho, that certain property
described hereafter be rezoned, it is hereby ordained as follows:
Section 1. That certain land described in Exhibit " A " attached
hereto, and by this reference incorporated herein, is now zoned R -1
Low Density Residential Zone, and is located within the City of Caldwell,
Canyon County, State of Idaho, the Council having previously annexed
said land to the City of Caldwell, Idaho.
Section 2. It is hereby declared by the Mayor and Council
of the City of Caldwell, Idaho, that the tract of land described
in Exhibit "A ", a proper legal description, to be declared to be
R -3 Multi- Family High Density Residential Zone, and shall be so changed
from R -1 Low Density Residential Zone to R -3 Multi- Family High Density
Residential Zone after the date of this Ordinance.
Section 3. The City Clerk of the City of Caldwell, and the
City Engineer of the City of Caldwell, are hereby instructed to so
designate the same above described property on the official zoning map
of the City of Caldwell, Idaho, as being R -3 Multi- Family High Density
Residential Zone property.
Section 4. All ordinances, resolutions, order, or parts

thereof in conflict herewith are hereby repealed, rescinded and
annulled.
Section 5. This ordinance shall be in full force and effect
from and after its passage, approval and publication according to law.
PASSED BY THE CITY COUNCIL of the City of Caldwell this
21st day of April , 1981.

EXHIBIT A

COMMENCING at the Southeast corner of the Southwest Quarter of
the Northeast Quarter of Section 28, Township 4 North, Range 3
West of the Boise Meridian, which point is, the Southeast corner
of Frost's Addition to Caldwell, Idaho, the official plat of
which is on file in Book 2 of Plats at page 83 in the office of
the Recorder of Canyon County, Idaho; thence North along the East
boundary of said Southwest Quarter of the Northeast Quarter, being
the centerline of Kimball Avenue as platted in said Frost's Addition,
165 feet to the TRUE POINT OF BEGINNING; thence continuing North
along the centerline of Kimball Avenue, 190 feet to the intersection
of the centerline of Kimball Avenue with the centerline of vacated
Mead Street as platted in said Frost's Addition; thence West along
the centerline of vacated Mead Street, 189 feet; thence South and
parallel with the West line of Block 4 of said Frost's Addition,
130 feet to a point on the north boundary of Lot 20 of said Block
4; thence West along the North boundary and North boundary extended
of said Lot 20, a distance of 141 feet to a point on the centerline
of Parker Avenue; thence South along the centerline of Parker Avenue,
225 feet to its intersection with the centerline of Logan Street;
thence East along the centerline of Logan Street, 165 feet to a point
which is on the centerline extended of the vacated alley as platted
in said Block 4; thence North along the centerline of said vacated
alley, 165 feet; thence East on a line parallel with the North boun-
dary of Lot 7 of said Block 4, 165 feet to the TRUE POINT OF BEGIN-
NING.
