AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY
OF CALDWELL, IDAHO, FROM R -2T MEDIUM DENSITY RESIDENTIAL ZONE TO
C -3T SERVICE COrMERCIAL ZONE AND DETERMINING THAT SAID CHANGE IN ZONING
IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO: REPEALING ALL
LAWS, ORDINANCES, AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
WHEREAS, It has been determined by the City Council of the
City of Caldwell, Idaho, upon recommendation of the Planning and Zoning
Commission of the City of Caldwell, Idaho, that it is in the best
interests of the City of Caldwell, Idaho, that certain property
described hereafter be rezoned, it is hereby ordained as follows:
Section 1. That certain lands described in Exhibit "A"
attached hereto, and by this reference incorporated herein, is now
zoned R -2T Medium Density Residential Zone, and is located within the
City of Caldwell, Canyon County, State of Idaho, the Council having
previously annexed said lands to the City of Caldwell, Idaho.
Section 2. It is hereby declared by the Mayor and Council
of the City of Caldwell, Idaho, that the tracts of lands described
in Exhibit "A ", a proper legal description, to be declared to be
C -3T Service Commercial Zone, and shall be so changed from R -2T Medium
Density Residential Zone to C -3T Service Commercial Zone after the date
of this Ordinance.
Section 3. The City Clerk of the City of Caldwell, and the
City Engineer of the City of Caldwell, are hereby instructed to so
designate the same above described property on the official zoning map
of the City of Caldwell, Idaho, as being C -3T Service Commercial Zone
property.
Section 4. All ordinances, resolutions, order, or parts

thereof in conflict herewith are hereby repealed, rescinded and
annulled.
Section 5. This ordinance shall be in full force and effect
from and after its passage, approval and publication according to law.
PASSED BY THE CITY COUNCIL of the City of Caldwell this

EXHIBIT A
All of Blocks 33, 34 and 35 of Golden Gate Addition, the official
plat of which is on file and of record in Kook 2 of Plats at Page
78 in the office of the Recorder of Canyon County, Idaho, lying
South and West of the following- described line:
BEGINNING at a point in the Southwesterly line of said Block 33
which is 40 feet Northwesterly from the South corner of said
Block 33; thence Northeasterly and parallel with the Southeasterly
line of said Block 33 to a point which is 136 feet from the
Northeasterly line of said Block 33; thence Northwesterly and par-
allel with the Northeasterly line of said Block 33 to the North-
westerly line of said Block 33; thence Northeasterly along the
Northwesterly line of said Block 33, a feet; thence Northwesterly
and parallel with the Northeasterly line of Block 34 of said Golden
Gate Addition, 1 feet; thence Southwesterly and parallel with
the Northwesterly line of said Block 34, 20 feet; thence North-
westerly and parallel with the Northeasterly line of said Block
34, 200 feet to the Northwesterly line of said Block 34; thence
Northwesterly to a point in the Southeasterly line of Block 35
of said Golden Gate Addition which is 120 feet Southwesterly from
the East corner of said Block 35; thence Northwesterly and parallel
with the Northeasterly line of said Block 35, 100 feet; thence North-
easterly and parallel with the Southeasterly line of said Block 35,
120 feet to the Northeasterly line of said Block 35; thence North-
westerly along the Northeasterly line of said Block 35 to the North
corner of said Block 35.
Street addresses of properties to be rezoned are 014 Ithaca, 016
Ithaca, 219 Hannibal and odd numbers of the 100 block on Hannibal
(the north frontage road of I -84 highway).
