ORDINANCE NO. 1592
AN ORDINANCE TO AMEND TITLE III, CHAPTER 3 OF THE MUNICIPAL CODE OF
THE CITY OF CALDWELL, STATE OF IDAHO, BY ADDING SECTION 32 PERTAINING
TO DISCHARGE OF ANY STORM WATER, SURFACE WATER, GROUND WATER, ROOF RUNOFF,
SUBSURFACE DRAINAGE, UNCONTAMINATED COOLING WATER OR UNPOLLUTED
INDUSTRIAL PROCESS WATER TO ANY SANITARY SEWER; AND PROVIDING FOR
PENALTIES; AND REPEALING ALL ORDINANCES, RESOLUTIONS, ORDERS OR PARTS
THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Chapter 3, Title III of the Municipal Code of the
City of Caldwell be amended by adding Section 32 as follows:
3 73 -32: DISCHARGE OF UNPOLLUTED WATER TO ANY SANITARY SEWER:
A It shall be unlawful for any person to discharge or cause to
be discharged any storm water, surface water, ground water, roof runoff,
subsurface drainage, uncontaminated cooling water, or unpolluted
industrial process waters to any sanitary sewer.
B Any person found to be violating any provision of this sec tion
shall be served with a written notice stating the nature of the violation
and providing a reasonable time limit for satisfactory correction thereof
The offender shall within the period of time stated in such notice
permanently cease all violations.
C Any person who shall continue any violation beyond the time
limit provided for in Section B shall be guilty of a mis demeanor.
Section 2. That all ordinances or parts of ordinances inconsistent
herewith are hereby repealed.
Section 3. This ordinance shall be in full force and effect from
and after its passage, approval and publication according to law.
