AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPROPRIATE
NOTICE THEREFOR WAS GIVEN: DETERMINING THAT VACATION OF THE FOLLOWING
DESCRIBED REAL PROPERTY SHALL BE MADE, TO -WIT:
That portion of Laster Lane lying between Lots 1, 2 $ 6, Block 1,
in the Happy Day Business Center, according to the official plat
on file in Book 17 of Plats at page 45, in the Office of the
Recorder of Canyon County, Idaho; more particularly described as
follows:
BEGINNING at the Southeast corner of said Lot 2 on the North boundary
of the Right of Way of Laster Lane; thence South 89 0 33 1 24" East,
44.05 feet along the South boundary of said Lot 6; thence 102.27
feet along the arc of a 125.40 feet radius curve left; said curve
having a chord bearing South 67 0 04 1 58`° West, 99.45 feet; thence
South 43 0 43 1 19" West, 28.25 feet; thence North 89 ° 33 1 24" West,
153.94 feet along the North boundary of said Lot 1; thence 47.72
feet along the arc of a 20.00 foot radius curve left, said curve
having a chord bearing South 22 0 05 1 39" West, 37.18 feet; thence
North 46 0 15 1 18" West, 151.76 feet along the Northeasterly boundary
of U.S. Highway 30; thence 26.45 feet along the arc of a 35.00
foot radius curve left, said curve having a chord bearing South
67 ° 54'21" East, 25.83 feet; thence South 89 0 33 1 24" East, 320.72
feet along the South boundary of said Lot 2 to the POINT OF
BEGINNING.
AND THAT SAID VACATION IS IN THE BEST PUBLIC INTEREST FOR THE CITY OF
CALDWELL, IDAHO:
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
Section 1. That by a Motion passed and approved by the Mayor of
the City of Caldwell, Idaho on the 2nd day of December, 1980, and
statutory notice having been given to citizens and owners of property
in the City of Caldwell, Idaho, that an application has been presented
to the Mayor and Council of the City of Caldwell, Idaho, requesting
passage and approval of an ordinance vacating the above described real
property located in Canyon County, Idaho, subject to the reservations
of all utility companies and all existing easement rights in the area
comprising easement rights for sewer lines, water lines, power lines,
telephone lines and gas lines as presently located thereon or therein,
with the further reservation to the City of Caldwell, if applicable, and
all utility companies with easement rights in the area comprising said
easement rights for access to and from said area to maintain, repair or

replace the preat existing sewer, water, OWer, telephone and gad
lines as presently located thereon or therein.
Section 2. That it is hereby determined that it is in the best
public interest that the above described premises in Canyon County,
Idaho, be vacated, subject to existing easement rights and further
easement rights as hereinabove set forth.
Section 3. Be it ordained and established that the above described
premises in Canyon County, Idaho, as more particularly described above,
shall be vacated and shall no longer be open or subject to the use of
the public and thereupon title to said premises in Canyon County,
Idaho, above described, shall revert to the persons dedicating the same
or their successors, heirs, and assigns, subject to existing easements
in the area comprising easements for sewer lines, water lines, power
lines, telephone lines and gas lines as presently located thereon or
therein, with the further reservation to all utility companies with
easement rights in the area for access to and from said area to maintain
repair or replace the present existing sewer, water, power, telephone
lines and gas lines as presently located thereon or therein. The
above described premises shall be vacated and shall pass and revert to
persons dedicating the same or their successors, heirs, and assigns
in the manner in whic h they were so dedicated.
PASSED BY THE COUNCIL of the City of Caldwell this 20th
day of January , 1981.
