HomeMy WebLinkAboutORD 1586BILL NO. 33 ORDINANCE NO. 1586 AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPROPRIATE NOTICE THEREFOR WAS GIVEN: DETERMING THAT VACATION OF THE FOLLOWING DESCRIBED REAL PROPERTY SHALL BE MADE, TO -WIT: A parcel of land being on the northeasterly side of the centerline of Interstate 80N Project No. I -80N- 1(67)27 Highway Survey as shown on the plans thereof on file in the office of the Idaho Transportation Department, Division of Highways, and being a portion of Indiana Avenue in Townhouse Addition to Caldwell, a replat of Tract 7, and part of Tracts 8 and 10, Hillcrest Subdivision, according to the plat of said addition filed February 10, 1972, in Book 11 of plats at page 1 in the office of the Recorder of Canyon County, Idaho, described as follows to -wit: BEGINNING at the Northwest Corner of Lot 12, Block 1 of said Townhouse Addition to Caldwell, Canyon County, Idaho; thence South 89 ° 28 1 15" West along the North line extended of said Lot 12 a distance of 13 feet to a point; thence South 71 ° 10 1 00" West a distance of 58.00 feet more or less to a point that bears Northeasterly 150.00 feet from Station 1483 + 79.61 of said Interstate 80N Project No. I -80N- 1(67)27 Highway Survey; thence South 55 ° 20 1 48" East, 75.68 feet to a point in the Easterly right of way line of said Indiana Avenue; thence Northerly along said Easterly right of way line, being a 45.0 -foot radius curve 65.0 feet more or less to the POINT OF BEGINNING. IS IN THE BEST PUBLIC INTEREST FOR THE CITY OF CALDWELL, IDAHO: BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: Section 1. That by a Motion passed and approved by the Mayor of the City of Caldwell, Idaho, on the 21st day of October, 1980, and statutory notice having been given to citizens and owners of property in the City of Caldwell, Idaho, that an application has been presented to the Mayor and Council of the City of Caldwell, Idaho, requesting passage and approval of an ordinance vacating the above described real property located in Caldwell, Canyon County, Idaho, subject to the reservations of all utility companies and all existing easement rights in the area comprising easement rights for sewer lines, water lines, power lines, telephone lines and gas lines as presently located thereon or therein, with the further reservation to the City of Caldwell, if applicable, and all utility companies with easement rights in the area comprising said easement rights for access to and from said area to maintain, repair or replace the present existing sewer, water, power, ORDINANCE - 1 telephone and gas lines as presently located thereon or therein. Section 2. That it is hereby determined that it is in the best public interest that the above described premises in the City of Caldwell, Canyon County, Idaho, be vacated, subject to existing easement rights and further easement rights as hereinabove set forth. Section 3. Be it ordained and established that the above described premises in the City of Caldwell, Canyon County, Idaho, as more particularly described above, shall be vacated and shall no longer be open or subject to the use of the public and thereupon title to said premises in the City of Caldwell, Canyon County, Idaho, above described, shall pass and revert to the persons owning that part of Lot 12, Block 1, Townhouse Addition, the official plat of which is on file and of record in the office of the Recorder of Canyon County, Idaho, excluding highway right of way, or their successors, heirs, and assigns, subject to existing easements in the area comprising easements for sewer lines, water lines, power lines, telephone lines and gas lines as presently located thereon or therein, with the further reservation to all utility companies with easement rights in the area for access to and from said area to maintain, repair or replace the present existing sewer, water, power, telephone lines and gas lines as presently located thereon or therein. The above described premises shall be vacated and shall pass and revert to the persons owning that part of Lot 12, Block 1, Townhouse Addition, the official plat of which is on file and of record in the office of the Recorder of Canyon County, Idaho, excluding highway right of way, or their successors, heirs, and assigned in the manner in which they were so dedicated.
