HomeMy WebLinkAboutORD 1583BILL NO. 30 ORDINANCE NO. 1583 0 AN ORDINANCE TO AMEND TITLE IV, CHAPTER 4, SECTIONS 4 AND 11 OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, REGARDING DOOR -TO -DOOR SALESMEN BY ADDING CERTAIN LANGUAGE IN SECTION 4 REGARDING BOND REQUIRED AND BY ADDING CERTAIN LANGUAGE IN SECTION 11 TO PROVIDE FOR WAIVING OF FEE: REPEALING ALL ORDINANCES, RESOLUTIONS, ORDER OR PARTS THEREOF IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That Title IV, Chapter 4, Section 4 of the Municipal Code of the City of Caldwell, County of Canyon, State of Idaho, shall be amended as follows: 4 -4 -4: BOND REQUIRED: Every applicant, except for those representing Community Civic Organizations or School Organizations shall file with the Clerk a surety bond running to the Municipality in the amount of one thousand dollars ($1,000.00) with the surety acceptable to and approved by the Mayor, conditioned that the said applicant shall comply fully with all the provisions of this Chapter. Action on such bond may be brought in the name of the Municipality the use or benefit of the aggrieved person. Section 2. That Title IV, Chapter 4, Section 11 of the Municipal Code of the City of Caldwell, County of Canyon, State of Idaho, shall be amended as follows: 4 -4 -11: REDUCTION OF FEES: The Mayor and /or Council shall have authority to reduce the license fee for hawkers, peddlers, or salesmen to three dollars ($3.00) per three (3) month period in any of the following instances: When the applicant is a resident of the City; when the applicant owns and /or operates a business in the City; when the applicant represents a civic organization and the funds derived from such hawking or peddling are used for charitable purposes; when the applicant is engaged in selling books, encyclopedias, Bibles or religious materials and the sale of such materials is deemed by the Mayor and /or Council to be in the public interest. The Mayor and /or ORDINANCE - 1 • 0 Council shall also have the authority to waive the fee providing they secure a license for display Section 3. That all ordinances or parts of ordinances inconsistent herewith are hereby repealed. Section 4. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. PASSED BY THE COUNCIL of the City of Caldwell this 4th day of November , 1980.
