AN ORDINANCE AMENDING TITLE VI, CHAPTERS 1, 2 AND 5 OF THE MUNI-
CIPAL CODE OF THE CITY OF CALDWELL, STATE OF IDAHO, WITH REFERENCE
TO THE "F" (FLOOD PLAIN) OVERLAY ZONE TO MAKE IT CONFORM TO THE
REQUIREMENTS OF THE FLOOD DAMAGE PREVENTION ORDINANCE BY CHANGES
IN THE TEXT AND MAP. AMENDED ARE: TITLE VI, CHAPTER 1, SECTION 5
BY ADDING A SECTION WITH REFERENCE TO THE BOUNDARIES OF THE "F"
(FLOOD PLAIN) OVERLAY ZONE; TITLE VI, CHAPTER 1, SECTION 6 BY
ADDING A SECTION REFERRING TO THE INTERPRETATION OF THE ZONE
BOUNDARIES; TITLE VI, CHAPTER 2, SECTION 2 BY DELETING CERTAIN
SECTIONS AND REVISING SECTIONS CONCERNING USES PERMITTED, STORAGE
OF MATERIALS AND EQUIPMENT, NON- LIABILITY CLAUSE, AND RESTRICTIONS;
AND TITLE VI, CHAPTER 5, SECTION 4 BY CHANGING CERTAIN LANGUAGE IN
THE DEFINITION OF THE FLOOD PLAIN; REPEALING ALL ORDINANCES, RESO-
LUTIONS, ORDERS OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALD-
WELL:
6 -1 -5: A section shall be added as follows:
D. The boundari o t he "F" (Flo Plain) Overlay Zone shall
be the areas of spe cial flood hazard zones designated as
Zones A, A5, A6 a nd A8 o the Flo Insurance Rate Map as
set forth in Se 5- 13 -3(B) of the Flood Damage Preven
tion Ordinance
6 -1 -6: The following section shall be added:
D. Flood Plain Overlay Zo boundaries shall be interpreted
as set forth in Section 5- 13 -3 of the Flood Damage
Prevention Ordinance
6 -2 -2: (A) Uses Permitted: All uses are permitted in the
respective zone with which "F" Overlay Zone is combined.

Delete 6- 2 -2(B). The following shall be added: 6- 2 -2(B) When
uses are authorized under the procedures provided for in this
Title .,all of the conditions of Title V, Chapter 13, will
also apply to the u permitted in an "F" Overlay Zone
Delete 6- 2 -2(C). The following shall be added: 6- 2 -2(C) Storage
of materi and Equipment: Materials that are buoyant
flammable, obnoxious, t oxic or otherwise injurious to persons
or property if transp by flood waters are prohibited

Storage of materials and equipment not having these char
acteristics is permissible only if the materials and equip
ment have low dam Potential and are anchored or are
readily remova from the area within the time available
after forecasting and warning
Delete 6- 2 -2(D). The following shall be added: 6- 2 -2 -(D) Non -
liability Clause: The granting of approval of any structure
or use in the " F" Overla Zone shall not constitute a repre
sentation guaran or warrant of any kind or nature by the
City or by any officer or employee thereof, of the practicality
or safety of any structure or use proposed and shall create
no liability upon or cause action against such public body
officer or e for any damage that may result pursuant
thereto
Delete 6- 2 -2(E) The following shall be added: 6- 2 -2(E) Restric
tions: Restrict regarding height, rear yards, side yards
front yard setback, minimum lot area, signs, vision c learance
and parking sp shall be th same as set forth in each speci
fic zone with wh ich the "F" Overlay Zone is combined
Delete 6- 2 -2(F).
Delete 6- 2 -2(G).
Delete 6- 2 -2(H).
6 -5 -4: FLOOD PLAIN: The relatively flat area or low land ad-
joining the channel of a river, stream, lake or other body
of water which has been or may be covered by water of a flood
of one hundred (100) year frequency. The flood plain includes
the channel, floodway and floodway fringe, as established per

by the Federal I Administration and designated as
areas A, A - 5 s A -6 and A -8 on the Flood Insurance Rate Map
Delete 6- 5 -4(A) through (E).
All ordinances or parts of ordinances inconsistent herewith are hereby
repealed.
This ordinance shall be in full force and effect from and after its
passage, approval and publication according to law.
