AN ORDINANCE TO ESTABLISH A LOCAL LATERAL SEWERAGE IMPROVEMENT DISTRICT IN THE CITY OF CALDWELL, IDAHO., TO PROVIDE FOR THE APPOINT- MENT OF A SEWERAGE COMMITTEE AND CONFERRING UPON THE1L CERTAIN POWERS TO PROVIDE FOR THE CONSTRUCTION OF A SYSTW OF LATERAL SEWERAGE AND SEWERAGE DISPOSAL WORKS IN SAID IMPROVEMENT DISTRICT. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL. Section l.- There is hereby established a local improvement district within the City of Caldwell, Idaho, to•�be known as "Local Lateral Sewerage Improvement District No.l ", which district is bounded and described as follows, to wit: Beginning at a point in the centre of the intersection of Sixth avenue and Arthur street, running thence North- westerly along the centre line of said Arthur street to the centre of the intersection.of Arthur street and Third avenue; Thence Northee terly alongthe centre of Third averrue to the intersection of the center of the alley between Arthur and Main streets; thence Southwesterly along the center of said alley to its intersection with the center of Sixth avenue; thence Southwesterly long the center of Sixth avenue to the point of beginning above described. Being all of Lots 13 to 24 , inclusive, in Blocks 0,1, 2 , Origional Townsite, City of Caldwell, County of Canyon, State of Idaho. All property fronting and abutting on any of the streets or alleys above mentioned between the points designated are hereby declared to be within the said d� sewer district. section 2.- The Mayor of the City of Caldi#Ehl shall within ten days after the passage of this ordinance, appoint a sewerage committee composed of three members who shall be bona fide residents andsbbstantial taxpayers of the City of Caldwell, olie of whom shall be appointed for one year, one for two years and one for three years, and they shall serve until their successors are appointed and qualified. Said committee shall organize and elect a president as a presiding officer of their number who shall be styled chairman of the coianittee, appoint a clerk and treasurer who shall be respectively the clerk and treasurer of the City of Caldwell, all as provided by law. Section 3.- The treasurer of said committee shall give a good and sufficient bond in addition to his official bond as treasurer of said city, in the Bum of Zkolla -re f cond.i do -ned for- the - faithful performance of his duties as such treasurer of said committee according to law. Section 4.- Said committee shall have all the powers contained in Chapter 14, Title 13, Political Code, Idaho Revised. roties, inchid ing the power to have specifications prepared for the construction of the works hereinafter provided fcT and to approve the same and do all things necessary to the completion of the said work. Section 5. - There shall be constructed iu the City of Caldwell thorugh said committee a system of sewerage and sewerage disposal works to be so planned and constructed as to be directly beneficial to the property situated within said lateral sewerage improvement district No. 1, and,of as . much benefit to the remainder of the city as in the judgment of said committee is possible. In adopting said plans the committee shall endeavor to cause the property wit within said district to receive'as nearly equal benefit as possible. Section 6.- Upon the adoption of the plans and specifications as herein provided, the said committee shall determine as equally as can be done the amount of money to be raised for the construction of the said works. Thereupon the said committee with the standing Committee on streets'of the city council shall proceed to make an assessment Boll of the real property contained within the bouiAltries of *Pid lateral sewerage imbrovement district No. 1, provided that property occupied by streets, cross streets and.alleys within said district shall not be included within said assessment roll. The sae.6 assessment roll shall contain the-names of the owners of the property assessed, a discription of the property in separate parcels or tracts, the front feet of the propety, the ry amount of•the special benefit to the property , if ahy, or the amount less than the average benefit, if any, and the amount assessed against the said property shall be equal to the amount of money determined upon as necessary to be raised as herein provided. Section 7.- The said assessment roll shall be certified to the council by the committees making the same., and the clerk shall thereupon give notice as required by law, of the filing of said assessment roll, and of the time at which the council will hear and consider and hear objections to said assessment roll by the party aggrieved by said assessment as provided by the laws of the State of Idaho hereinbefore mentioned. The proceedings for hearing suaid objections, and all the actions of the concil and the parties thereto, shall conform to the provisions of the aforesaid laws. Section S.- When the said system is compleated and ready for use, the said committee shall turn the said system over to the said Mayor and city council to be operated by the said cifr Section 9. The said sewerage committee shall=,;e governed in the performanc® of their duties in addition to what is here- in contained, by all the provisions of the laws of the State of Idaho, relating to Cities and Villages.
