ORDINANCE NO. 1565
AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPROPRIATE
NOTICE THEREFOR WAS GIVEN: DETERMINING THAT VACATION OF THE FOLLOWING
DESCRIBED REAL PROPERTY AND EASEMENTS OF THE FOLLOWING DESCRIBED
REAL PROPERTY SHALL BE MADE, TO -WIT:
I. A parcel which is a portion of a right of way for Industrial
Way, as shown on the Plat for Industrial Site #4 as on file
in the Office of the Recorder for Canyon County, Idaho, in
Book 17 at Page 21 and is situated in the Northeast Quarter
of the Southeast Quarter of Section 26, Township 4 North,
Range 3 West of the Boise Meridian and is more particularly
described as follows:
BEGINNING at the Southeast corner of Lot 1, Block of said
Industrial Site #4; thence South 24 44' 50" East along a
line parallel with and 25.00 feet Westerly of the Westerly
right of way boundary for Interstate 84, a distance of 126.17
feet; Thence South 0 01' 25" East, a distance of 1.35 feet;
Thence North 63 23' 05" West, a distance of 313.78 feet;
Thence Northwesterly, a distance of 61.38 feet along the arc
of a curve to the right, having a radius of 130.00 feet, a
central anggle of 27 03' 05" and a long chord which bears
North 49 51' 32" West, a distance of 60.81 feet; Thence
North 36 20' 00" West, a distance of 318.99 feet; Thence
North 55 46' 17" East, a distance of 80.05 feet; Thence South
36 20' 00" East, a distance of 316.07 feet; Thence Southwesterl}
a distance of 23.61 feet along the arc of a curve to left,
having a radius of 50.00 feet, a central anggle of 27 03' 05"
and a lon chord which bears South 49 51' 32" East, a distance
of 23. g 39 feet; Thence South 63 23' 05" East, a distance
of 214.60 feet to the TRUE POINT OF BEGINNING.
II. All of the easements in the plat of Industrial Site No. 4
subdivision to the City of Caldwell, Idaho, which was recorded
April 10, 1979, as Instrument No. 858764 in the office of the
Recorder of Canyon County, Idaho.
AND THAT SAID VACATION IS IN THE BEST PUBLIC INTEREST FOR THE CITY OF
CALDWELL, IDAHO:
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
Section 1. That by a Motion passed and approved by the Mayor
of the City of Caldwell, Idaho on the 1st day of July, 1980, and published
in the NEWS - TRIBUNE, a newspaper published in the City of Caldwell, Idaho,
in two issues thereof on the 30th day of June, 1980, and on the 7th day
of July, 1980, and statutory notice having been given to citizens and
owners of property in the City of Caldwell, Idaho, that an application
has been presented to the Mayor and Council of the City of Caldwell,
Idaho, requesting the passage and approval of an ordinance vacating the

above- described real property and easements in the Plat of Industrial
Site No. 4 located in Caldwell, Canyon County, Idaho.
Section 2. That it is hereby determined that it is in the best
public interest that the above described premises in the City of
Caldwell, Canyon County, Idaho, be vacated.
Section 3. Be it ordained and established that the above
described premises in the City of Caldwell, Canyon County, Idaho, as
more particularly described above shall be vacated and shall no longer
be open or subject to the use of the public; and thereupon title to said
premises in the City of Caldwell, Canyon County, Idaho, above described,
shall pass and revert to the persons dedicating the same or their
successors, heirs, and assigns. The above described premises shall be
vacated and shall pass and revert to the persons dedicating the same,
or their successors, heirs and assigns in the manner in which they were
so dedicated.
Section 4. That all ordinances or parts of ordinances in
conflict herewith are hereby repealed.
PASSED BY THE COUNCIL OF THE CITY OF CALDWELL this 15th
day of July , 1980.
