ORDINANCE NO. 1561
AN ORDINANCE AMENDING THE ZONING MAP AND ZONING CLASSIFICATION
OF THE CITY OF CALDWELL, IDAHO, SO AS TO CHANGE THE CLASSIFICATION
OF SAID PROPERTY FROM R -2 MEDIUM DENSITY RESIDENTIAL ZONE TO R -3
MULTI- FAMILY HIGH DENSITY RESIDENTIAL ZONE AND PROVIDING AN
EFFECTIVE DATE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF i
CALDWELL, IDAHO:
Section 1. Pursua-nt to the procedures and requirements of
Chapter 65, Title 67, Idaho Code, and pursuant to the findings of the
City Council that existing zoning classifications for the property
hereinafter described be, as a result of changed circumstances in the
development of said area, amended and reclassified to promote the public
health, safety and welfare, the land use zoning classification of the
following described lands and territory of the City of Caldwell be, and
the same hereby is, changed from R -2 Medium Density Residential to
R -3 Multi- family High Density Residential, to -wit:
A part of the Northeast Quarter of the Northwest Quarter of
Section 35, Township 4 North, Range 3 West of the Boise
Meridian and a part of Tract U, in the Mountain View Subdivision,
marked exhibit " A " and incorporated herein by reference and
attachment.
Section 2. In addition to the findings herein before set
borth, the City Council further finds that such zoning reclassification
is in conformity to the City of Caldwell's Comprehensive Plan 2000 and
that said reclassification is necessary for the following reasons:
(a) That this rezone is consistent with the Comprehensive Plan
2000 and all other adopted plans and policies of the City.
(b) That all urban services are available and capable of servicing
the site.
(c) That the proposed rezone is compatible with adjacent zoning
and development.
Section 3. The zoning map of the City of Caldwell, Idaho, as
the same is provided by Section 6 -1 -5 of the Caldwell City Code, is
hereby changed, altered, and amended to include and insert the real

property described in Section 1 hereof in the land use classification
therein described.
Section 4. This Ordinance shall be in full force and effect
from and after its passage, approval and publication hereof.
PASSED BY THE COUNCIL of the City of Caldwell, Idaho this 15th
day of April , 1980.

A part of the Northeast Quarter of the Northwest Quarter of Section
35, Township 4 North, Range 3 West of the Boise Meridian and a part
of Tract U, in the Mountain View Subdivision, according to the
official plat on file in Book 2 of Plats at page 66, in the office
of the Recorder of Canyon County, Idaho, more particularly described
as follows:
BEGINNING at the Southeast Corner of said Northeast Quarter of the
Northwest Quarter, monumented with a brass cap marked PE 627 (con-
sidered to be .a monument of common report); thence South 89
West, 661.15 feet (of record as 662.0 feet on the Mountain View
Subdivision) along the South boundary of said Northeast Quarter of
the Northwest Quarter and the centerline of Cherry Street; thence
North 0 0 26'37' East, 654.92 feet (of record as 660.6 feet on the
Mountain View Subdivision) partially along the West boundary of
said Tract U; thence South 89 0 53 1 27" East, 157.42 feet along the
centerline of Locust Street as located by former surveys of common
report; thence South 46 0 14 1 11" East, 692.32 feet parallel with and
300 feet Southwest of the centerline of the Nampa - Caldwell Boule-
vard; thence South 0 0 27 1 20" West, 171.08 feet aloAg the East boundary
of said Northeast Quarter of the Northwest Quarter and the centerline
of Florida Avenue to the POINT OF BEGINNING.
Property corner addresses for the tract would be 2704 Locust Street,
2703 Cherry Street and 2821 Cherry Street.
