ORDINANCE N0. 1558
AN ORDINANCE AMENDING TITLE IX, CHAPTER 2 OF THE MUNICIPAL CODE
OF THE CITY OF CALDWELL, STATE OF IDAHO, RELATING TO DOGS AND
OTHER ANIMALS BY AMENDING SECTION 4 REGARDING APPLICATION FOR
LICENSE AND LICENSE FEES; SECTION 9 REGARDING KENNELS; SECTION 10
REGARDING RABIES; SECTION 18 REGARDING LICENSED DOGS IMPOUNDED;
SECTION 19 REGARDING UNLICENSED DOGS IMPOUNDED; SECTION 20 RE-
GARDING ADDITIONAL FEES AND CHARGES; SECTION 21 REGARDING IMPOUND-
ING OF ANIMALS; BY DELETING AND ADDING CERTAIN LANGUAGE REGARDING
DOGS AND OTHER ANIMALS; REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDER OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
CALDWELL:
Section 1. That Section 4, Chapter 2, Title IX of the
Municipal Code of the City of Caldwell be amended as follows:
9 -2 -4; APPLICATION FOR LICENSE AND LICENSE FEES: All dogs shall
be licensed. The owner or person having charge of any dog
within the limits shall make application to the Gkie€
e €- Peliee City Clerk and pay a license fee in the sum of
rkree- dollars- E$3:AA) five dollars ($5.00) for each and every
neutered male or female dog owned, or the sum of Five- dellars-
03 -AAA ten dollars for each and every male or female dog
owned which is not neutered. In the event that the owner
claims that the dog is neutered, then and in that event, he
shall present such evidence as may be required by the Gkie€
e €- Peliee City Clerk to establish that the dog is neutered,
which evidence may include a statement from a licensed and
qualified veterinarian.
All dogs shall be licensed for and by the calendar year:
January 1 through December 31.
Upon satisfactory proof that a license tag has been lost, a
new tag of a different number may be issued by the Gkie € -@E
Peliee City Clerk upon payment of a fee of one dollar ($1.00)

and the transaction shall be noted upon the City office
files for the number that was originally issued.
Section 2. That Section 9, Chapter 2, Title IX of the
Municipal Code of the City of Caldwell be amended to read as
follows:
9 -2 -9: KENNELS: The owner of any five - {5) Begs -ar -mere, more
than two (2) dogs regardless of age shall be deemed the
operator of a dog kennel. Said dog kennel shall be kept,
at all times in a clean and sanitary condition and the dogs
shall be reasonably restrained from annoying the neighbor-
hood or the general public by loud, frequent, or habitual
barking, yelping or howling.
The application for kennel license shall state the name and
address of the owner of said kennel, the location where kennel
is to be kept and the number of dogs proposed to be kept.
No kennel shall be established within one hundred fifty feet
(150') of any dwelling house other than that of the kennel
owner; provided, however, that a kennel license may be issued
by the City to establish a kennel within one hundred fifty
feet (150') of a dwelling house other than that of the
kennel owner upon consent of all property owners within three
hundred feet (300') of the kennel.
If a Kennel license is issued, the holder thereof shall pay
the City an annual license fee of fifty dollars ($50.00) and
said certificate of license shall be posted in a conspicuous
place at the kennel. No kennel license shall be transferable.
It shall be unlawful to keep, maintain or possess upon the
premises of any one household more than five - <5)- two (2)
dogs unless the owner or person in charge thereof shall have
obtained a kennel license. Provided further, that in the

event the number of dogs upon the premises of any one house-
hold exceeds the number of five- {§) more than two (2) for the
reason that new -born puppies have been born to a dog living on
said premises, then and in that event, it shall be lawful to
keep, maintain and possess upon said premises, said puppies
until they reach the age of six (6) months without obtaining
a kennel license.
Section 3. That Section 10, Chapter 2, Title IX of the
Municipal Code of the City of Caldwell be amended to read as follows:
9 -2 -10: RABIES: The Animal Control Officer or any other Police
Officer of the City shall have the authority to order the
owner of any dog which has bitten any person in such a manner
so as to cause an abrasion of the skin to subject such dog to
the City Pound for quarantine for a period of fifteen (15) days.

Provided further that no dog shall be subject to quarantine or
impoundment that has had current rabies shots
Provided further if said dog shall be quarantined it shall be at
a licensed veterinary kennel where dog is to be held for observa
tion at the owners expense
Section 4. That Section 18, Chapter 2, Title IX of the Municipal
Code of the City of Caldwell be amended as follows:

shall be the duty of the Animal Control Officer to cause notice
to be served upon the registered owner of any licensed dog im-
pounded under the provisions of this Chapter, in person, by
telephone or by leaving notification upon the door at the last
known address. Any dog not redeemed within forty -eight (48)
hours after notice shall be declared to be a stray dog and a
public nuisance and may be disposed of in a humane manner under
the direction of the Chief of Police.
Section 5. That Section 19, Chapter 2, Title IX of the Municipal
Code of the City of Caldwell be amended as follows:
9 -2 -19: UNLICENSED DOGS IMPOUNDED: It shall be the duty of the
Animal Control Officer to hold for a period of €ive - { §) -days
forty -eight (48) hours any unlicensed dog impounded under the
provisions of this chapter. Any such unlicensed dog not redeemed
within said five-(S)-days forty -eight (48) hour period shall be
declared to be a stray dog and a public nuisance and may be
disposed of in a humane manner under the direction of the Chief
of Police.
Section 6. That Section 20, Chapter 2, Title IX of the Municipal
Code of the City of Caldwell be amended as follows:
9 -2 -20: ADDITIONAL FEES AND CHARGES: Any person recovering
possession of a lieensed dog impounded under the provisions
of this Chapter shall pay a fee of tkree- dollars- {$3 -89). Any -

first offense, fifty dollars ($50.00) for second offense
and one hundred dollars ($100.00) for any third or subsequent
occurrence in addition to obtaining a license for said dog
if not licensed.
The Animal Control Officer or any other Police Officer of the
City, at the request of any person, shall pick up and dispose of
any dog that they are the owner The charge for this service
shall be five dollars ($5.00) which must be paid to the City
at time such animal is picked up.
Section 7. That Section 21, Chapter 2, Title IX of the
Municy.pal Code of the City of Caldwell be amended as follows:
9 -2 -21: IMPOUNDING OF ANIMALS: If any animals shall be found
running at large contrary to the provisions of this Chapter,
it is hereby made the duty of the Animal Control Officer or
any other Police Officer of the City to take up and confine the

Such animal taken up and confined shall not be released until
the owner or person entitled to have possession thereof shall
pay all fees including all expenses incurred in taking up and
boarding such animal so impounded in a private facility
Impounded dogs taken up and confined at the City Pound shall not
be released until the owne or person entitled to have
possession thereof shall pay the City of Caldwell a fee o
five dollars ($5.00) per day or part thereof
All fees and boarding services for the taking up of animals
shall be payable to and- eelleeted- by- tke- Poliee Department - of
tke- Gity- ef- 6aldwell person having control of impounding
facilities.
Section 8. All ordinances or parts of ordinances inconsistent
herewith are hereby repealed.
Section 9. This ordinance shall be in full force and effect
from and after its passage, approval, and publication according to law.
