ORDINANCE NO. 1555
AN ORDINANCE AMENDING TITLE V, CHAPTER 8 OF THE MUNICIPAL CODE
OF THE CITY OF CALDWELL, STATE OF IDAHO, RELATING TO SUBDIVISIONS
BY AMENDING SECTIONS 3 (B), SECTION 6 (B.1), SECTION 6 (D.4), AND
SECTION 7 (B.3, C.7, AND C.11) BY ADDING CERTAIN LANGUAGE REGARDING
SUBDIVISION REGULATIONS; REPEALING ALL ORDINANCES, RESOLUTIONS,
ORDER OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF
CALDWELL:
Section 1. That Section 3 (B), Chapter 3, Title V of the
Municipal Code of the City of Caldwell be amended by adding B.5 as
follows:
5 -8 -3: (B) 5. An industrial subdivision in an area which meets the
requirements of the zoning ordinance after a preliminary_
plat and the development plans for streets, water and
sewer improvements have been approved by the Planning and
Zoning Commission and the City Council

Section 2. That Section 6 (B.1), Chapter 8, Title V of the
Municipal Code of the City of Caldwell be amended to read as follows:
5 -8 -6 (B) BLOCK REQUIREMENTS:
1. No block shall be longer than six hundred sixty feet (660
nor less than two hundred fifty feet (250 between street
intersections and shall have sufficient width to provide for
two (2) tiers of lots except as provided in subsection (C)
of this Section of a special exception approved by the City
Council. The block length and width set forth herein may be
varied by the City Council for an industrial subdivision
Section 3. That Section 6 (D.4), Chapter 8, Title V of the
Municipal Code of the City of Caldwell be amended to read as follows:
5 -8 -6 (D.4)
4. There shall be provided rights -of -way of such width in no
case to be less than those defined in the Comprehensive Plan
for the City, provided, however, that the width of said rights -
of -way shall in no case be less than the following:

Section 4. That Section 7 (B.3), Chapter 8, Title V of the
Municipal Code of the City of Caldwell be amended to read as follows:
5 -8 -7 (B.3)
3. At the time of filing the Final Plat, the subdivider for
all subdivisions except industrial shall file with the City
Clerk a surety bond or other guarantee acceptable to the
Council to secure to the City the actual construction of
such improvements according to specifications within a period
of time not to exceed one year from the date of approval of
the Final Plat; provided, however, that the Council may extend
the allowed period of construction for one year upon the
showing of just cause by the subdivider. Such bond or other
guarantee shall be in the amount of one hundred ten percent (110 %)
of the estimated cost of the improvement as determined by the
Council.
At the time of filing a final plat for an industrial
subdivision, the subdivider shall have a written agreement
with the City Council for the construction of the improvements
according to the approved plans and specifications and within
the time limits as agreed upon.
Section S. That Section 7 (C.7), Chapter 8, Title V of the
Municipal Code of the City of Caldwell be amended to read as follows:
5 -8 -7 (C) 7. Sidewalks four feet (4') in width shall be provided on
both the sides of any residential collector and other minor
residential street. Sidewalks shall also be provided along
any other street in a subdivision where deemed by the Council
to be essential to public convenience or safety. In industrial
subdivisions, sidewalks shall not be requ within the

5 -8 -7 (C), 11. All utilities shall be placed underground in all
subdivisions except industrial
Section 7. All ordinances or parts of ordinances inconsistent
herewith are hereby repealed.
Section 8. This ordinance shall be in full force and effect
from and after its passage, approval, and publication according to law.
