ORDINANCE NO. 1548
AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF THE CITY OF CALDWELL,
CANYON COUNTY, IDAHO, THAT THE MAYOR AND CITY COUNCIL INTEND TO SELL,
LEASE, OR TRADE THE FOLLOWING DESCRIBED REAL PROPERTY OWNED BY THE CITY
OF CALDWELL, CANYON COUNTY, IDAHO; AND WHICH SAID PROPERTY IS SITUATED
IN CANYON COUNTY, IDAHO; THAT SAID SALE, LEASE, OR TRADE IS MADE UNDER
THE PROVISIONS OF TITLE 50, CHAPTER 14, IDAHO CODE; THAT SAID SALE,
LEASE, OR TRADE OF SAID PROPERTY SHALL BE AT PUBLIC AUCTION AND SHALL
BE SOLD, LEASED, OR TRADED TO THE HIGHEST BIDDER AND THAT NO BID SHALL
BE ACCEPTED FOR LESS THAN THE APPRIASED VALUE; SAID PROPERTY BEING
DESCRIBED AS FOLLOWS, TO WIT:
Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 12, 13, 14, 15, 16, 17,
18, 19, 20, 21, 22 and Fractional Lots 23 and 24, all in Block 35
DORMANS ADDITION to Caldwell, Idaho, according to the Plat of said
Addition filed July 22, 1891 in Book 1 of Plats at Page 19, in
the office of the County Recorder, Canyon County, Idaho, and;
All of Fractional Block 17 FAIR ACRES, Caldwell, Idaho, according
to the Plat thereof filed August 28, 1903 in Book 1 of Plats at
Page 33, in the office of the County Recorder, Canyon County,
Idaho.
BE IT ORDAINED AND ESTABLISHED BY THE MAYOR AND COUNCIL OF THE
CITY OF CALDWELL, CANYON COUNTY, IDAHO:
Section 1. That the Mayor and Council of the City of Caldwell,
Idaho, hereby intend to sell, lease, or trade at public auction the
following described real property situated within Canyon County, Idaho,
said property being described as follows, to wit:
Lots 1, 2, 3, 4, 5, 6, 7, 8, 9, 10, 11,12, 13, 14, 15, 16, 17,
18, 19, 20, 21, 22 and Fractional Lots 23 and 24, all in Block 35
DORMANS ADDITION to Caldwell, Idaho, according to the Plat of said
Addition filed July 22, 1891 in Book 1 of Plats at Page 19, in the
office of the County Recorder, Canyon County, Idaho, and;
All of Fractional Block 17 FAIR ACRES, Caldwell, Idaho, according
to the Plat thereof filed August 28, 1903 in Book 1 of Plats at
Page 33, in the office of the County Recorder, Canyon County, Idaho.
Section 2. That the ordinance for the sale, lease, or trade of
said above described real property will be considered under a suspension
of the requirements that an ordinance be read on three different days at
a meeting of the Council of the City of Caldwell, Idaho, to be held on
the 16th day of October, 1979, at the hour of seven - thirty o'clock p.m.
at the Council Chambers in the City Hall in the City of Caldwell, Idaho,
when and where, or prior to said date, any citizen of the City of Caldwell,
Idaho, or any number of citizens may express dissatisfaction with said

sale, lease, or trade as set forth in Section 50 -1203 Idaho Code, wherein
it is provided that if a petition expressing dissatisfaction with said
sale, lease, or trade containing the names of qualified electors of the
City in a number equal to ten percent (100) of the total votes cast
for Mayor at the preceding City election is filed with the City Clerk
during sixty (60) days from the passage of this ordinance, the City
Council shall cause a special election to be held on the question of
whether or not the real property shall be sold, leased, or traded.
Section 3. The said above described property shall be sold, leased,
or traded at public auction to the highest bidder and no bid shall be
accepted for less than the appraised price and the City Council may
reject any and all bids.
Section 4. Notice of the foregoing will be given to all citizens
of the City of Caldwell, Canyon County, Idaho, by publication of this
ordinance in the City of Caldwell, Idaho, in three issues thereof
published on the 20th day of October, 1979, the 27th day of October, 1979,
and the 3rd day of November, 1979.
Section 5. That this ordinance shall be in force and effect
from and after its passage, approval and publication.
