HomeMy WebLinkAboutORD 1533BILL NO. 17 ORDINANCE NO. 1533 AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO, FROM R -1 RESIDENTIAL ZONE TO R -2 RESIDENTIAL ZONE AND R -3 RESIDENTIAL ZONE AND DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO: REPEALING ALL LAWS, ORDINANCES, AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon recommendation of the Planning and Zoning Commission of the City of Caldwell, Idaho, that it is in the best interests of the City of Caldwell, Idaho, that certain property described hereafter be rezoned, it is hereby ordained as follows: Section 1. That certain lands described in Exhibit "A" attached hereto, and by this reference incorporated herein, is now zoned R -1 Residential Zone, and is located within the City of Caldwell, Canyon County, State of Idaho, the Council having previously annexed said lands to the City of Caldwell, Idaho. Section 2. It is hereby declared by the Mayor and Council of the City of Caldwell, Idaho, that the tracts of lands described in Exhibit "A ", a proper legal description, to be declared to be R -2 Residential Zone and R -3 Residential Zone, and shall be so changed from R -1 Residential Zone to R -2 Residential Zone and R -3 Residential Zone after the date of this Ordinance. Section 3. The City Clerk of the City of Caldwell, and the City Engineer of the City of Caldwell, are hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho, as being R -2 Residential Zone and R -3 Residential Zone property. Section 4. All ordinances, resolutions, order, or parts ORDINANCE - 1 w i thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. PASSED BY THE CITY COUNCIL of the City of Caldwell this 15th day of May , 1979. APPROVED BY THE MAYOR of the City of Caldwell this 15th day of May , 1979. a or ATTEST: 0 0 EXHIBIT "A" The following parcel of land to be changed from R -1 Residential to R -3 Residential: BEGINNING at the Northwest corner of Section 28, Township 4 North, Range 3 West of the Boise Meridian; thence East along the North boundary of said Section 28 to its intersection with the centerline of Sunset Avenue; thence South along the center- line of Sunset Avenue to its intersection with the centerline of Sunnyside Drive; thence West along the centerline of Sunny- side Drive to the West boundary of said Section 28; thence North along the West boundary of said Section 28 to the POINT OF BEGINNING. The following parcel of land to be changed from R -1 Residential to R -2 Residential: BEGINNING at the intersection of the centerline of Sunset Avenue with the centerline of Woodlawn Drive; thence West along the centerline of Woodlawn Drive to its intersection with the West boundary of Section 28, Township 4 North, Range 3 West of the Boise Meridian; thence North along the West boundary of said Section 28 to its intersection with the centerline of Sunnyside Drive; thence East along the centerline of Sunnyside Drive to its intersection with the centerline of Sunset Avenue; thence South along the center- line of Sunset Avenue to its intersection with the centerline of Woodlawn Drive, the TRUE POINT OF BEGINNING.
