ORDINANCE NO. 1530
AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY
OF CALDWELL, IDAHO, FROM R -3T RESIDENTIAL ZONE to C -3T COMMERCIAL ZONE
AND DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF
THE CITY OF CALDWELL, IDAHO: REPEALING ALL LAWS, ORDINANCES, AND
RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, IDAHO:
WHEREAS, it has been determined by the City Council of the
City of Caldwell, Idaho, upon recommendation of the Planning and Zoning
Commission of the City of Caldwell, Idaho, that it is in the best
interests of the City of Caldwell, Idaho, that certain property
described hereafter be rezoned, it is hereby ordained as follows:
Section 1. That certain lands described in Exhibit "A"
attached hereto, and by this reference incorporated herein, is now
zoned R -3T Residential Zone, and is located within the City of Caldwell,
Canyon County, State of Idaho, the Council having previously annexed
said lands to the City of Caldwell, Idaho.
Section 2. It is hereby declared by the Mayor and Council
of the City of Caldwell, Idaho, that the tracts of lands described
in Exhibit "A ", a proper legal description, to be declared to be
C -3T Commercial Zone, and shall be so changed from R -3T Residential Zone
to C -3T Commercial Zone after the date of this Ordinance.
Section 3. The City Clerk of the City of Caldwell, and the
City Engineer of the City of Caldwell, are hereby instructed to so
designate the same above described property on the official zoning map
of the City of Caldwell, Idaho, as being C -3T Commercial Zone property.
Section 4. All ordinances, resolutions, order, or parts

thereof in conflict herewith are hereby repealed, rescinded and
annulled.
Section 5. This ordinance shall be in full force and
effect from and after its passage, approval and publication according
to law.

BEGINNING at the West corner of Lot 11 of Block 45 of the official
plat of CALDWELL, IDAHO, on file and of record in the office of the
Recorder of Canyon County, Idaho; thence Southwesterly along the
Northwesterly boundary of said Lot 11 extended, 40.00 feet to the
centerline of Chicago Street; thence Southeasterly along the
centerline of Chicago Street, 90.00 feet to the intersection of
the centerline of Chicago Street with the centerline of 13th Avenue;
thence Northeasterly along the centerline of 13th Avenue, 168.00
feet; the Northwesterly and parallel with the Northeasterly bound-
ary and the Northeasterly boundary extended of Lots 11 and 12 of
said Block 45, 90.00 feet to a point which is on the centerline
of the alley in said Block 45; thence Southwesterly along the
Northeasterly boundary of said Lot 11 and Lot 11 extended, 128.00
feet to the POINT OF BEGINNING.
