HomeMy WebLinkAboutORD 1529S r BILL NO. 13 ORDINANCE NO. 1529 AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO FROM R -2 RESIDENTIAL ZONE TO R -3T RESIDENTIAL ZONE AND DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO: REPEALING ALL LAWS, ORDINANCES, AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon recommendation of the Planning and Zoning Commission of the City of Caldwell, Idaho, that it is in the best interests of the City of Caldwell, Idaho, that certain property described hereafter be rezoned, it is hereby ordained as follows: Section 1. That certain lands described in Exhibit " A " attached hereto, and by this reference incorporated herein, is now zoned R -2 Residential Zone, and is located within the City of Caldwell, Canyon County, State of Idaho, the Council having previously annexed said lands to the City of Caldwell, Idaho. Section 2. It is hereby declared by the Mayor and Council of the City of Caldwell, Idaho, that the tracts of lands described in Exhibit "A ", a proper legal description, to be declared to be R -3T Residential Zone, and shall be so changed from R -2 Residential Zone to R -3T Residential Zone after the date of this Ordinance. Section 3. The City Clerk of the City of Caldwell, and the City Engineer of the City of Caldwell, are hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho, as being R -3T Residential Zone property. Section 4. All ordinances, resolutions, order, or parts ORDINANCE - 1 thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. PASSED BY THE CITY COUNCIL of the City of Caldwell this 15th day of May , 1979. ATTEST: Mayor City cler Knight Exhibit "A" BEGINNING at the Southeast corner of Government Lot 3, situated in the Southwest Quarter of the Northwest Quarter of Section 15, Township 4 North, Range 3 West of the Boise Meridian; thence North along the East boundary of said Government Lot 3 to its intersection with the centerline of Plymouth Street; thence Northerly along the centerline of Plymouth Street to its inter- section with the North boundary line of Government Lot 3; thence West along the North line of said Government Lot 3 to the Northwest corner of said Government Lot 3; thence Southerly along the East bank of the Boise River, 374.9 feet; thence continuing Southerly along the East bank of the Boise River, 953.8 feet to the South- west corner of said Government Lot 3; thence West along the South boundary of said Government Lot 3, 460..1 feet to the POINT OF BEGINNING.
