AN ORDINANCE RECITING PETITION TUR V=ION AND RECITING
APPROPRIATE NOTICE THEREFOR WAS GIVEN: DETERMING THAT VACATION
OF THE SEWER EASEMENT OF THE FOLLOWING DESCRIBED REAL PROPERTY,
TO -WIT:
A vacation of a sewer easement in the Southerly half of the
block bounded by Ellis and Arlington Avenues and Elm and
Hazel Streets, providing for the rerouting of the sewer
for the construction of Hazel Park Senior Citizen Development
in Caldwell, Idaho, Canyon County, more particularly
described as follows:
COMMENCING at the Northeast corner of said Southwest
Quarter of the Northeast Quarter of the Southeast Quarter;
thence South 0 East, along the East boundary of
said Southwest Quarter of the Northeast Quarter of the South-
east Quarter, a distance of 299.00 feet to a point on the
North boundary of Hazel Street; thence North 89 West
parallel with the North boundary of said Southwest Quarter
of the Northeast Quarter of the Southeast Quarter, a distance
of 151.00 feet to the TRUE POINT OF BEGINNING; thence
continuing North 89 West, a distance of 16.00 feet;
thence North 0 West, parallel with the East boundary
of said Southwest Quarter of the Northeast Quarter of the
Southeast Quarter, a distance of 95.00 feet; thence South
89 East, parallel with the North boundary of said
Southwest Quarter of the Northeast Quarter of the Southeast
Quarter, a distance of 16.00 feet;thence South 0 East,
a distance of 95.00 feet to the TRUE POINT OF BEGINNING;
EXCEPTING therefrom, the lands described in the Easement
in Instrument No. 857462 recorded on March 27, 1979, and
filed in the Miscellaneous Records of the Recorder of
Canyon County, Idaho.
IS IN THE BEST PUBLIC INTEREST FOR THE CITY OF CALDWELL, IDAHO:
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
Section 1. That by a Motion passed and approved by the Mayor
and City Council of the City of Caldwell, Idaho, on the 20th day of
March, 1979, and statutory notice having been given to citizens and
owners of property in the City of Caldwell, Idaho, that an application
has been presented to the Mayor and Council of the City of Caldwell,
Idaho, requesting passage and approval of an ordinance vacating the
above Sewer Easement located in Caldwell, Canyon County, Idaho.
Section 2. That it is hereby determined that it is in the best
ORDINANCE - 1
public interest that the above described Sewer Easement in the City
of Caldwell, Canyon County, Idaho, be vacated and that the sewer be
rerouted.
Section 3. Be it ordained and established that the above
described Sewer Easement in the City of Caldwell, Canyon County, Idaho,
as more particularly described above, shall be vacated and shall no
longer be subject to the use of the public; and thereupon title to
said Sewer Easement in the City of Caldwell, Canyon County, Idaho,
above described, shall pass and revert to the persons dedicating the
same or their successors, heirs, and assigns. The above described
Sewer Easement shall be vacated and shall pass and revert to the
persons dedicating the same, or their successors, heirs and assigns in
the manner in which they were so dedicated.
Section 4. That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
PASSED BY THE COUNCIL of the City of Caldwell this 17th day
of April , 1979.
