AN ORDINANCE AMENDING TITLE III, CHAPTER 3 OF THE MUNICIPAL
CODE OF THE CITY OF CALDWELL STATE OF IDAHO, RELATING TO
WATER PAYMENTS BY AMENDING SECTION 10 BY ADDING CERTAIN LANGUAGE
TO PROVIDE FOR AN APPEALS BOARD AND A CHANGE IN THE WATER TURN
ON CHARGE; REPEALING ALL ORDINANCES, RESOLUTIONS, ORDER OR PARTS
THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY
OF CALDWELL:
Section 1. That Section 10, Chapter 3, Title III of the
Municipal Code of the City of Caldwell be amended to read as follows:
3 -3 -10: WATER PAYMENTS: All water charges for domestic water furnished
by the Water Department shall be due on billing date. Billing
date as used herein shall mean the date on which the bill is
mailed by the City. Said billing date shall be noted on each bill.
Water service shall be discontinued to premises forty (40) days
after billing date if said bill is not paid in full; provided,
however, that before water services shall be discontinued the
owner shall first be given ten (10) days notice of the date on
which said water service will be discontinued. Said notice may be
given by specific notice of the service discontinuance date on a
regularly issued water bill. With the regularly issued water bill
will be an enclosed statement showing that the water bill is past
due and subject to service being discontinued. The statement will
provide for the following
(A) If owner feels the bill is in conflict with their records
they should discuss it with the Water Department or the Mayor
(B) An Appeals Board will meet in the Council Chambers every
Wednesday at 9:00 a.m.
(C) Owner may present his case with or without counsel on the

Wednesday prior to turn off date
(D) A fair and impartial hearing will hear the case and a written
decision will be submitted bV the Board to the owner and the
Water Department at the conclusion of the hearing

If water service should be discontinued for nonpaymen of water
bill, it shall not thereafter be continued until all delinquent
water charges are paid in full togehter with a five d ollar ($5.001
turn on charge
No person other than authorized City personnel shall turn water
on at any premises. Violation of this provision shall be a
misdemeanor.
Section 2. All ordinances or parts of ordinances inconsistent
herewith are hereby repealed.
Section 3. This ordinance shall be in full force and effect
from and after its passage, approval, and publication according to
law.
