HomeMy WebLinkAboutORD 15100 Wt BILL NO. 58 ORDINANCE NO. 1510 AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO, FROM R -2 RESIDENTIAL ZONE TO C -3 COMMERCIAL ZONE AND DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO: REPEALING ALL LAWS, ORDINANCES , AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon recommendation of the Planning and Zoning Commission of the City of Caldwell, Idaho, that it is in the best interests of the City of Caldwell, Idaho, that certain property described hereafter be rezoned, it is hereby ordained as follows: Section 1. That certain lands described in Exhibit "A" attached hereto, and by this reference incorporated herein, is now zoned R -2 Residential, and is located within the City of Caldwell, Canyon County, State of Idaho, the Council having previously annexed said lands to the City of Caldwell, Idaho. Section 2. It is hereby declared by the Mayor and Council of the City of Caldwell, Idaho, that the tracts of lands described in Exhibit "A ", a proper legal description, to be declared to be C -3 Commercial Zone, and shall be so changed from R -2 Residential Zone to C -2 Commercial Zone after the date of this Ordinance. Section 3. The City Clerk of the City of Caldwell, and the City Engineer of the City of Caldwell, are hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho, as being C -3 Commercial Zone property. Section 4. All ordinances, resolutions, order, or parts ORDINANCE - 1 a thereof in conflict herewith are hereby repealed, rescinded and annulled. Section 5. This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. ATTEST: yor City Clerk_. . 0 0 1.- EXHIBIT A COMMENCING at the Southwest corner of Lot 6 of Lafferty's Addi- tion to the City of Caldwell; thence North 310.2 feet to the Northwest corner of said Lot 6; thence East along the North line of said Lot 6, a distance of 151.6 feet; thence South- easterly along the Northeasterly line and the Northeasterly line extended of Lot 6 to its intersection with the centerline of Canal Street; thence Southeasterly along the centerline of Canal Street to its intersection with the South boundary of said Lafferty's Addition; thence West along the South boundary of said Lafferty's Addition to a point 30.00 feet South of the POINT OF BEGINNING; thence North 30.00 feet to the POINT OF BEGINNING.
