ORDINANCE NO. 1509
AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY
OF CALDWELL, IDAHO, FROM R -3T RESIDENTIAL ZONE TO C -2 COMMERCIAL ZONE
AND DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF
THE CITY OF CALDWELL, IDAHO: REPEALING ALL LAWS, ORDINANCES, AND
RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, IDAHO:
WHEREAS, it has been determined by the City Council of the
City of Caldwell, Idaho, upon recommendation of the Planning and Zoning
Commission of the City of Caldwell, Idaho, that it is in the best
interests of the City of Caldwell, Idaho, that certain property
described hereafter be rezoned, it is hereby ordained as follows:
Section 1. That certain lands described in Exhibit "A"
attached hereto, and by this reference incorporated herein, is now
zoned R -3T Residential, and is located within the City of Caldwell,
Canyon County, State of Idaho, the Council having previously annexed
said lands to the City of Caldwell, Idaho.
Section 2. It is hereby declared by the Mayor and Council
of the City of Caldwell, Idaho, that the tracts of lands described
in Exhibit "A ", a proper legal description, to be declared to be
C -2 Commercial, and shall be so changed from R -3T Residential Zone to
C -2 Commercial Zone after the date of this Ordinance.
Section 3. The City Clerk of the City of Caldwell, and the
City Engineer of the City of Caldwell, are hereby instructed to so
designate the same above described property on the official zoning map
of the City of Caldwell, Idaho, as being C -2 Commercial Zone property.
Section 4. All ordinances, resolutions, orders, or parts

thereof in conflict herewith are hereby repealed, rescinded and annulled.
Section 5. This ordinance shall be in full force and effect
from and after its passage, approval and publication according to law.

EXHIBIT A
•
BEGINNING at the intersection of the centerline of Albany Street
with the centerline of Twelfth Avenue; thence Southwesterly along
the centerline of Twelfth Avenue 305.00 feet to the intersection
of the centerline of Twelfth Avenue with the centerline of the
Oregon Short Line Railroad main line; thence Northwesterly 165.00
feet along the centerline of the Oregon Short Line Railroad main
line to its intersection with the Northwesterly lot line of Lot
8, Block 86 extended; thence Northeasterly 305.00 feet along the
Northwesterly lot line of said Lot8 extended and Lot 8 to its
intersection with the centerline of Albany Street; thence South-
easterly 165.00 feet to the POINT OF BEGINNING.
