ORDINANCE NO. 1503
AN ORDINANCE AMENDING THE MUNICIPAL CODE OF THE CITY OF
CALDWELL, STATE OF IDAHO, BY AMENDING TITLE VI, CHAPTER 2,
SECTION 2.1, TABLE I PROVIDING A CHANGE IN THE LAND USE
SCHEDULE OF THE ZONING REGULATIONS; AND BY AMENDING TITLE VI,
CHAPTER 2, SECTION 2.1, TABLE 2 BY PROVIDING FOR SETBACKS FOR
DWELLINGS IN THE COMMERCIAL AND INDUSTRIAL ZONES: REPEALING
ALL ORDINANCES, RESOLUTIONS, ORDER OR PARTS THEREOF IN
CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1. That Title VI, Chapter 2, Section 2.1, Table I
of the Municipal Code of the City of Caldwell, Canyon County, Idaho,
be amended as follows:

NOTE:
1. Excluding commercial feed lots, raising of swine, commercial
poultry, dairies (as defined) and similar intensive agri-
related uses. Horses or other usual farm animals are permitted
when kept on at least one (1) acre of land per animal or unless
permitted to exceed this amount by Special Permit. Buildings
housing horses and other usual farm animals shall not be
located closer than fifty (50) feet from any property line.
Horses and usual farm animals shall be kept in buildings or
enclosures approved by the City.
2. May be permitted as a home occupation if criteria are met.

Section 2. That Title VI, Chapter 2, Section 2.1, Table 2
of the Municipal Code of the City of Caldwell, Canyon County, Idaho,
be amended as follows:

HEIGHT, SETBACK AND AREA SCHEDULE (5)
Minimum Setback Yard Requirements (in feet)
(1) The minimum lot area for each dwelling unit above that required
for two - family dwellings shall be fifteen hundred square feet
for each additional unit unless the lot area is permitted to be
reduced by Special Permit procedures in the case of high rise
and similar development proposals.
(2) The maximum height may be exceeded by Special Permit.
(3) Residential uses shall have the same requirements as set forth
in the R -3 zone. When commercial or industrial. uses abut a
residential zone, setbacks shall be the same as are required
in the adjacent residential district. lihen residences are located
in commercial and industrial zones setbac re u rements are the
same as or res ent a zones.
(4) A total of twelve (12) feet for both sideywards with one side being
not less than four (4) feet.
(5) Refer also to supplementary setback provisions in Section 3.1.4
and 3.2.

Section 3. All ordinances or parts of ordinances
inconsistent herewith are hereby repealed.
Section 4. This ordinance shall be in full force and effect
from and after its passage, approval, and publication according to
law.
