ORDINANCE N0. 1493
AN ORDINANCE AMENDING TITLE 3, CHAPTER 3, SECTION 14 OF THE
MUNICIPAL CODE OF THE CITY OF CALDWELL, STATE OF IDAHO, REGARDING
ILLEGAL CONNECTION BY ADDING CERTAIN LANGUAGE THEREIN; BY ADDING
SECTION 14B REGARDING NOTICE: DISCONTINUE SERVICE; REPEAL SECTION
29 REGARDING ILLEGAL CONNECTION; REPEALING ALL ORDINANCES,
RESOLUTIONS, ORDER OR PARTS THEREOF IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND THE COUNCIL OF THE CITY OF
CALDWELL:
Section 1. That Section 14, Chapter 3, Title 3 of the
Municipal Code of the City of Caldwell be amended to read as follows:
3 -3 -14: ILLEGAL CONNECTION:
(A) It shall be unlawful for any person to make or cause
to be made any connection with the City water mains or to introduce
or cause to be introduced water from the City water mains into any
connection made therewith unless a permit has been first duly issued for
such purpose by the Superintendent of Waterworks in compliance and
conformity with the provisions of this Chapter and the rules and
regulations of the City that are now or may hereafter be established
therefor; or to cause a connection to become in non - compliance with the
provisions of this Chapter and the rules and regulations of the City that
are now or may hereafter be established or to interfere with or injure
any hydrant, pipe connection, meter or any property of the Waterworks
System of the City. Violation of this provision shall be a misdemeanor
(B) Notice; discontinue service: The City, by and through
the Water Superintendent, shall give notice in writing to the owner and /or
occupant of any premises connected to and served by City water mains in all
cases in which said connections are illegal. Said notice shall state the
violation and require that the violation be cured within thirty (30) days
from notice thereof or water service will be discontinued
In the event that said illegal connection continues beyond the thirty

(30) day period, the City is authorized to discontinue water service to
said premises without further notice and until said illegal connection
is discontinued. A violation of this provision is a misdemeanor
Provided however, that this Section shall be applied prospectively from
and after passage and approval of this Act, and water will not be
discontinued to any premises based upon this Amendment as a result of
any illegal connection which said illegal connection existed on the date
of passage and approval of this Act
Section 2. That Section 29, Chapter 3, Title 3 of the
Municipal Code of the City of Caldwell be repealed.
Section 3. All ordinances or parts of ordinances inconsistent
herewith are hereby repealed.
Section 4. This ordinance shall be in full force and effect
from and after its passage, approval, and publication according to law.
