AN ORDINANCE PROHIBITING THE SALE OR GIVING AWAY OF
ANY INTOXICATING LIQUORS WITHIN TI-11's CITY OP CALDWELL,
IDAHO, PROVIDING A PENALTY FOR THE VIOLATION OF THIS
ORDIWANCE, AND REPEALING ALL ORDINANCES OR PARTS OF
ORDINANCES IN CONFLICT WITH THIS ORDINANCE.
BE IT ORDAINED BY T' MAYOR AND COUNCIL OF THE CITY OF
CALDWE,LL IDAHO:

Section l It shall be IMIUWfUl for any person, firm, corporation,
society or club, either directly or indirectly, to sell
or give awav to anv person or persons within the corporate
liiaitsof the City of Caldwell, Idaho, any spirituoue,
malt or fermented liquors or wines of any kind. Druggists
t3_111y licensed as such are exempted from the provisions
of this section. PROVIDED, however, that such druggist
shall, only dispose of such liquors upon a prescription
froiti a duly licensed Etrid practict4,, physician.
Section 2.- Any person or persons violating any Of the provisions
of this ordivance shall be dee wed. guilty of a misdolneanor
and upon conviction thereof shall be punished by a fine
of not less than TWENTY DOLLARS and not more than
O= HUIURED DOLLARS, and upon failure to pay such fine
shall. be iiiiprisoned in the City jail until such fine is
satisfied im proportion of one days imprisoiunent for
