AN ORDINANCE
TO REQULAIfTHE BUILDING OF SIDEWALKS AND CROSSING'S IN
THE CITY OF CALDWELL, IDAHO,AND REPEALING ORDINANCE
NO 62 OF SAID CITY, ENTITLED " An Ordinance to regulate
tie building of sidewalks and crossings in the nity of
Caldwell" PASSED AND APPROVED BY THE MAYOR AND COUNCIL
OF SAID CITY ON THE 11TH DAY OF SEPTEMBER, 1905.
BE IT ORDAINED BY THE MAYOR AND COUNCIL
of the City of Caldwell:
Section 1.- All sidewalks hereinafter laid within the City of
Caldwell, Idaho, shall be constructed and maikntadned
in the manner and form hereinafter set forth in this
ordinance.
Section 2.- All sidewalks hereinafter sonstructed within the
City of Caldwell, Idaho, shall 00nf0r1fl to one of the
following plans of construction, which shall be known
as plans 1, 2, 3, and 4 of this ordinance.
Under plan 1 which shall include all that portion of
of the said City of Caldwell within Lockgl Improvement
District No. 1 , as established by Ordinance No. 130,
Pa: ;sed by the Council of said City on the 14th day of
July, 1909, and approved by the Mayor of said City on tb
the 15th day of July, 1909, the sidewalk shall be
fifteen feet wide, indluding the curb j measuring from
the line of the block to the outside of the curb in
accordance with the grade already established or to be
hereafter established by the City Engineer,and shall be
constructed of Portland cement in the manner hereinafter
set forth.
Under plan 2 which shall include all that portion
of the City of Caldwell, within the fire limits as now
established or to be hereafter established, except that
portion thereof included in plan 1 of this ordinance,
the sidewalks shall be twelve feet wide including the
curb, measuring from the line of the block to the outsicb
of the curb in accordance with the grade already
established or to be hereafter established by the City
Engineer and shall be constructed of Portland cement
in the manner hereinafter described.
Under plan 3 which shall include such portions of
the said City of Caldwell as the Council may doers
necessary a-id advisable and not heretofore included
in plans 1 and 2 of this ordinance, the said sidewalk
shall be five feet wide and constructed of Portland
cement. At the block corners the sidewalk shall extend
to the curb line and shall be constructed by the owner
of the corner property adjobent tq said sidewalk."
The grade of the sidewalk may be such as shall be
established by the City Engineer.
Under plan 4 which shall include that portion of
the said City of Caldwell not heretofor included in
plans 1, 2, or 3, the sidewalk shall be five feet wide.
There shall be three sills not less than two by four
inches in dimension, which shall be laid upon a good and
substantial foundation. The covering shall be not less
than one and one -half inches thick planks laid cross-
wise of the walk. The grade of the walk shall bg such
as established - by the City Engineer.
Section 3.- All curbs shall be eighteen inches in depth, eight
inches in width at the botomn, and six inches in width
at the top and shall be beveled or rounded on the upper
and outer edge At all street and alley crossings,
the corners shall be quadrants of twee feet radius.
Section 4.- The space over which the walk, constructed under
plan 1,2, or 3 is ; to be laid shall be excavated to
the proper sub -grade and thoroughly compacted by rolling
or ramming. Any objectionable or unsuitable material
below the sub -grade shall be removed and the space filled
with gravel or•sand well rammed into place. Care must
be taken in excavating to preserve the proper slope
pareldll with the surface of the finished walk.
Upon this foundation shall be laid a bed of concrete
three inches in thickness, to be made as follows:
Que part of good cement to be approved by the street
colmQitt6a and three parts of clean, coarse, sharp sand
to be thoroughly mixed dry and made into mortar with
the least possible amount of water; to this shall be
added six parts of broaken stone or gravel; said stone
or gravel shall not exceed one and one -half inches in
largests dimension, thoroughly separated from dirt and
drenched with water, but containing no loose water in the
heap. This shall be incorporated immediately with the
specified measure of mortar and thoroughly mixed. It
shall then be spread and at once be made thouroughly
compact by ramming until free mortar appears on the
surface. The upper surface shall be made exactly
parala11 with the surface of the completed walk. The
mortar and concrete shall not be mixed in greater quanti.-
ties than is required for immediate use, and none remain-
ing unused until having set again be remixed or used in
any way. The whole operation of mixing and laying each
batch of concrete shall be performed as expeditiously
as possible.
Upon this Buse the wearing surface hall be laid

an inch in thickness. It shall bet.Y
composed of one part of good cement andcne part of sand.
The sand must be sharp, silicious Lad free from aluminous
and other foreign substances.
The wearing surface shall be wade as follows:

sufficient quantity of water afterwards added to form
a paste of property consistency. It shall be expedit-
iously mixed and none of it shall be used after it has
been mixed one -half hour or evidence of setting is
apparant. The wearing surface shall be laid upon the
concrete base while the latter is still soft and
adhesive, and must be thorooughly worked and brought
to a uniform but roughened surface; it must be slate
colored and must be protected from the action of the
sun, wind, rain and frost until thouroughly set.
Section 5.- All crosswalks shall be not less th an four feet in
width, and shall be laid in line with the widdle of
the sidewalk, at or near the sideline of the street,
as the street committee shall designate# They shall
be so constructed se as to permit the water to flow
uninterruptedly down the gutter.and shall extend from
curd line to cuYb line. They shall rest on sills of
four by six inches in dimensions and not less than four
feet in length and well embedded in theearth. The Lop' °
of the walk shall be two inches above the grade of the
street. The crossing shall be twelve inih plank three
inches thick and shall be laid lengthwise of the walk.

and so placed that the upper edge shall be level Vith
the top of the walk and the lower and outer edge s
shall be one inch below the grade of the street. The
covering plank shall extend to within five feet of the
curb. The crosswalk shall be connected with the sidewalk
by aprons five feet long, four feet wide and made of
two inch plank. The covering plank of the aprons shall
be securely spiked to the sills with not less than
forty-penny nails.
Cement in lieu of board walks may be constructed
whereever the street committee may deem the same to be
for the best interests of the said City of Caldwell
and they shall be constructed of Portland cement.
Section 6.° Upon a petition being presented to the City Council
for the construction of a sidewalk on any of the streets
of the City of Caldwell, the city council may by
resolution, order that said sidewalk or any portion
thereof be constructed; said order shall state the
plan under which the said sidewalk is to be constructed,
and the property in front of which the same is to be
constructed, and shall require the property owners
in front of which the same is to be constructed to
construct the same within 2(rj days after the
publication of such resolution. The said resolution
shall be published for one week in the official newspaper
printed and published In the City of Caldwell, Idaho.
PROVIDED, that by a two - thirds vote of the council,
the council may by resolution, order a sidewalk construct-
ed in any portion of the streets without regard to a
petition therefor.
Section 7.- Whenever the property owners in front of whose property
the sidewalk has been ordered as hereinbefore provided,
shall construct the same in pursuance of such order,
they shall on completion of the sidewalk notify the
street commissioner who shall immediately inspect and
examine the walk so constructed and if it has been
constructed according to the provisions of this ordinance,
he shall report the same to the city council who may
accept the same on behalf of the city. If the same
has not been constructed according to the provisions
of this ordinance, the street cormaissio rier shall ?'
notify the property owners of any defects in such
construction and require them to complete such construc-
tion of such sidewalk in accordance with the provisions
of this ordinance.
Section a.- whenever a sidewalk or any portion thereof, which
has been ordered as hereinbefore provided, shall not
be constructed within the time specified in the notice
provided for in Section 6 of this ordinance, by the
owners of the lots in front of which the said sidewalk
Is to be constructed, then the City or Caldwell shall
construct the same by contract, let to the lowest bidder
after ten days notice given by the mayor, upon an
order or the Uity council, pubished in at least one
issue of the orra.ciat newspaper, which notiea shall
describe brierly the walk to oe constructed and the time
and place for the opening of bids for such construction.
At the block corners the s%deoalk shall extend to the curb line an(t steal]
ve constructed by the owner of tt F corner property, adjacent to said
sidewalk.
Section 9. Immediately after the completion of any eon-
tract`pro.vided for in this ordinance, the contr•actof! shall notify
the City Clerk and, if the owner or owners of the property pay be--
fore the claim of the contractor is allowed by the City 0011rici_1
the City Clerk shall accept the contract price; but if the owner
or owners bait after the city has raid the contractor aril before
the same has been certified to the count, assessor as special
taxes, the clerk shall accept in payment the contract I:rice and
interest on the claim at t },e rate of 10 per cent per annurn# from
the time said ra;mrent was made by the city to the contractor until
the same has been raid by the owner or owners. Tf not paid on or
before October 1 of the fiscal year, the city clerk shall certify
who shall enter it
the same to the tax collector of the count - a<ainst the name of the
owner of the rr•oper•ty on the assessment roll, upon whose property
the improvement, construction or grading, as the case may be, has
been made and SILall be lien against the said properly, into
whosesoever• hands in ray pass. The amorznt assessed and certified
by the clerk shall be the amount of the contractor's claim to-
�ether with interest on tle claim from the time settlement was
same
rude with the contractor until January first of the fiscal year
the assessment is made at the rate of 10 per cent per annum.
' After any sidewalk construction contract# has been let by thO City
Council all payments shall be made to the City Clerk.
Section 10. All set',lements by the tax collector witY
tie city shall be made according to the provisions of Sec. 2266
Chapter 7, Title 13, I. R. C.
Section 11. Ordinance No. 6'1 entitled "An Ordinance to
regulate the building of sidewalks and crossings in the City of
Cald�raell" pas8ed and approved by the Mayor of said city on the 11th
day of September, 1905, and all or inances in conflict with this
ordinance are hereby expressly
