HomeMy WebLinkAboutORD 1475BILL NO. 23 ORDINANCE NO. 1475 AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPROPRIATE NOTICE THEREFOR WAS GIVEN: DETERMINING THAT VACATION OF THE FOLLOWING DESCRIBED REAL PROPERTY SHALL BE MADE, TO -WIT: COMMENCING at the Westerly corner of Lot 5 in the Replat of Blocks 84 and 85 of Golden Gate Addition to Caldwell, according to the official plat on file in Book 5 of Plats at Page 3 in the office of the Recorder of Canyon County, Idaho; thence South 46 0 48 1 20" East, 10.00 feet along the Southwesterly boundary of said Lot 5 to the REAL POINT OF BEGINNING; thence con- tinuing South 46 0 48 1 20" East, 14.00 feet; thence North 43 ° 11 1 40" East, 120.00 feet; thence North 46 0 48 1 20" West, 14.00 feet along the Northeasterly boundary of said Lot 5; thence South 43 ®11 West, 120.00 feet to the REAL POINT OF BEGINNING. IS IN THE BEST PUBLIC INTEREST FOR THE CITY OF CALDWELL, IDAHO: BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: Section 1. That a Public Hearing was set by the Mayor of the City of Caldwell, Idaho, on thel8th day of October, 1977. and statutory notice having been given to citizens and owners of property in the City of Caldwell, Idaho, that an application has been presented to the Mayor and Council of the City of Caldwell, Idaho, requesting passage and approval of an ordinance vacatinv the above - described Sewer Easement located in Caldwell, Canyon County, Idaho. Section 2. That it is hereby determined that it is in the best interest of the public that the above described Sewer Ease- ment in the City of Caldwell, Canyon County, Idaho, be vacated. Section 3• Be it ordained and established that the above described premises in the City of Caldwell, Canyon County, Idaho, as more particularly described above, shall be vacated and shall no longer be open or subject to the use of the public; and there- upon title to said premises in the City of Caldwell, Canyon County, Idaho, above described, shall pass and revert to the persons de- dicating the same or their successors, heirs, and assigns. The above described premises shall be vacated and shall pass and revert to the persons dedicating the same, or their successors, heirs and assigns in the manner in which they were so dedicated. ORDINANCE - 1 Section 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. PASSED BY THE COUNCIL OF THE CITY OF CALDWELL, this 6th day of June 1978.
