HomeMy WebLinkAboutORD 1473r L BILL NO. 21 ORDINANCE NO. 1473 AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE CITY OF CALDWELL, IDAHO, FROM R -3T RESIDENTIAL ZONE TO C -2T COMMERCIAL ZONE AND DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST OF THE CITY OF CALDWELL, IDAHO: REPEALING ALL LAWS, ORDINANCES, AND RESOLUTIONS IN CONFLICT HEREWITH. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: WHEREAS, it has been determined by the City Council of the City of Caldwell, Idaho, upon recommendation of the Planning and Zoning Commission of the City of Caldwell, Idaho, that it is in the best interests of the City of Caldwell, Idaho, that certain property described hereafter be rezoned, it is hereby ordained as follows: Section 1. That certain lands described in Exhibit "B" attached hereto, and by this reference incorporated herein, is now zoned R -3T Residential, and is located within the City of Caldwell, Canyon County, State of Idaho, the Council having previously annexed said lands to the City of Caldwell, Idaho. Section 2. It is hereby declared by the Mayor and Council of the City of Caldwell, Idaho, that the tracts of lands described in Exhibit "B ", a proper legal description, to be declared to be C -2T Commercial Zone, and shall be so changed from R -3T Residential Zone to C -2T Commercial Zone after the date of this Ordinance. Section 3. The City Clerk of the City of Caldwell, and the City Engineer of the City of Caldwell, are hereby instructed to so designate the same above described property on the official zoning map of the City of Caldwell, Idaho as being C -2T Commercial Zone property. Section 4. All ordinances, resolutions, orders, or parts thereof in conflict herewith are hereby repealed, rescinded and annulled. ORDINANCE - 1 0 Section 5. Mayor ATTEST: City Clerk ORDINANCE - 2 EXHIBIT B Part of the Southeast Quarter of Section 22, Township 4 North, Range 3 West of the Boise Meridian, more particularly described as follows. BEGINNING at the North corner of Lot 7, Block 43, Original Town - site, Caldwell, Idaho; thence Northeasterly 8 feet along the Northwesterly line of Lot 7 extended to the intersection with the centerline of the alley in said Block 43; thence Southeas- terly 190 feet along the centerline of said alley to its inter- section with the centerline of Eleventh Avenue; thence South- westerly 168 feet along the centerline of Eleventh Avenue to the intersection of the centerline of Chicago Street; thence North- westerly 190 feet along the centerline of Chicago Street to the intersection of the Westerly line of said Lot 7 extended with the centerline of Chicago Street; thence Northeasterly 160 feet to the POINT OF BEGINNING.
