HomeMy WebLinkAboutORD 1465BILL NO. 13 ORDINANCE NO. 1465 AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPROPRIATE NOTICE THEREFOR WAS GIVEN: DETERMINING THAT VACATION OF THE SEWER EASEMENT OF THE FOLLOWING DESCRIBED REAL PROPERTY, TO -WIT: An easement for main or lateral sewer purposes, 14 feet in width and lying over and across a part of Block 77 in the GOLDEN GATE ADDITION to Caldwell, Idaho, according to the official plat on file in Book 2 of Plats at page 78 in the office of the Recorder of Canyon County, Idaho; more particularly described as follows: COMMENCING at the North corner of said Block 77; thence South 46 East, 310.19 feet along the Northeasterly boundary of said Block 77 to the POINT OF BEGINNING; thence continuing South 46 East, 14.00 feet along the Northeasterly boundary of said Block 77; thence South 43 West, 296.07 feet parallel with and 16.00 feet Northwesterly from the Southeasterly boundary of said Block 77; thence North 46 West, 14.00 feet along the Southwesterly boundary of said Block 77; thence North 43 East, 296.07 feet to the POINT OF BEGINNING. IS IN THE BEST PUBLIC INTEREST FOR THE CITY OF CALDWELL, IDAHO: BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, IDAHO: Section 1. That by a Motion passed and approved by the Mayor and City Council of the City of Caldwell, Idaho, on the 21st day of February, 1978, and statutory notice having been given to citizens and owners of property in the City of Caldwell, Idaho, that an application has been presented to the Mayor and Council of the City of Caldwell, Idaho, requesting passage and approval of an ordinance vacating the above Sewer Easement located in Caldwell, Canyon County, Idaho. Section 2. That it is hereby determined that it is in the best V uublic interest that the above described Sewer Easement in the City of Caldwell, Canyon County, Idaho, be vacated. Section 3. Be it ordained and established that the above described Sewer Easement in the City of Caldwell, Canyon County, Idaho, as more particularly described above, shall be vacated and shall no longer be subject to the use of the public; and thereupon title to said Sewer Easement in the City of Caldwell, Canyon County, Idaho, above ORDINANCE - 1 described, shall pass and revert to the persons dedicating the same or their successors, heirs, and assigns. The above described Sewer Easement shall be vacated and shall pass and revert to the persons dedicating the same, or their successors, heirs and assigns in the manner in which they were so dedicated. Section 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. PASSED BY THE COUNCIL OF THE CITY OF CALDWELL THIS 21st DAY OF March , 1978.
