ORDINANCE NO. 1463
AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPROPRIATE
NOTICE THEREFOR WAS GIVEN: DETERMINING THAT VACATION OF THE UTILITY,
IRRIGATION, AND DRAINAGE EASEMENT OF THE FOLLOWING DESCRIBED REAL
PROPERTY, TO -WIT:
COMMCNCING at the Southeast corner of Lot 12, Block 6; thence
North 89 0 26'00" West, 58.02 feet along the South boundary of
said Lot 12 to the POINT OF BEGINNING; thence continuing North
89 0 26'00" West, 10.00 feet along the South boundary of said
Lot 12 to a point 48.00 feet East of the centerline of Sunset
Avenue; thence parallel with the centerline of Sunset Avenue the
following courses: North 0 0 21'57" East, 48.47 feet; thence
107.79 feet along the arc of a 272.17 foot radius curve left,
said curve having a chord bearing North 10 0 58'46" West, 107.08
feet; thence North 22 0 19'29" West, 201.39 feet; thence 69.77
feet along the arc of a 176.17 foot radius curve right, said
curve having a chord bearing North 10 0 58'46" West, 69.31 feet;
thence North 0 0 21'57" East, 68.19 feet; thence South 89 0 26'00"
East, 10.00 feet along the North boundary of said Lot 3, Block
5; thence parallel with the centerline of Sunset Avenue the
following courses: South 0 0 21'57" West, 68.15 feet; thence
65.81 feet along the arc of a 166.17 foot radius curve left,
said curve having a chord bearing South 10 0 58'46" East, 65.38
feet; thence South 22 0 19 1 29" East, 201.39 feet; thence 111.75
feet along the arc of a 282.17 foot radius curve right, said
curve having a chord bearing South 10 0 58'46" East, 111.02 feet;
thence South 0 0 21'57" West, 48.50 feet to the POINT OF BEGINNING;
Excepting therefrom other existing easements shown or noted on
the Plat which are not to be vacated, more particularly described
as follows: The North 10 feet and the South 10 feet of Lot 12,
Block 6; the North 10 feet and the South 10 feet of Lot 1, Block
6; the South 10 feet of Lot 4, Block 5 and the right -of -way
for Walnut Street;
And, also to be vacated:
COMMENCING at the Southeast corner of said Lot 16; thence North
89 0 26 1 00" West, 20.00 feet along the South boundary of said Lot
16 to the POINT OF BEGINNING; thence continuing North 89 0 26'00"
West, 10.00 feet; thence North 0 0 21'57" East, 64.03 feet; thence
South 89 ° 24'58" East, 10.00 feet; thence South 0 0 21'57" West,
64.03 feet to the POINT OF BEGINNING.
IS IN THE BEST PUBLIC INTEREST FOR THE CITY OF CALDWELL, IDAHO:
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
Section 1. That by a Motion passed and approved by the Mayor
and City Council of the City of Caldwell, Idaho, on the 21st day of
February, 1978, and statutory notice having been given to citizens and
owners of property in the City of Caldwell, Idaho, that an application
ORDINANCE - 1
has been presented to the Mayor and Council of the City of Caldwell,
Idaho, requesting passage and approval of an ordinance vacating the
above described Utility, Irrigation and Drainage Easement located in
Caldwell, Canyon County, Idaho.
Section 2. That it is hereby determined that it is in the best
public interest that the above described Utility, Irrigation, and
Drainage Easement in the City of Caldwell, Canyon County, Idaho, be
vacated.
Section 3. Be it ordained and established that the above
described Utility, Irrigation, and Drainage Easement in the City of
Caldwell, Canyon County, Idaho, as more particularly described above,
shall be vacated and shall no longer be subject to the use of the public;
and thereupon title to said Utility, Irrigation, and Drainage Easement
in the City of Caldwell, Canyon County, Idaho, above described, shall
pass and revert to the persons dedicating the same or their successors,
heirs, and assigns. The above described Utility, Irrigation, and
Drainage Easement shall be vacated and shall pass and revert to the
persons dedicating the same, or their successors, heirs and assigns in
the manner in which they were so dedicated.
Section 4. That all ordinances or parts of ordinances in conflict
herewith are hereby repealed.
PASSED BY THE COUNCIL OF THE CITY OF CALDWELL THIS 21st DAY
OF March 1978.
APPROVED BY THE MAYOR OF THE CITY OF CALDWELL THIS 2 1st DAY
