ORDINANCE N0. 1461
AN ORDINANCE DETERMINING THAT CERTAIN LANDS ARE CONTIGUOUS AND
ADJACENT TO THE CITY OF CALDWELL, STATE OF IDAHO, AND DECLARING
SAID LANDS, BY PROPER LEGAL DESCRIPTION THEREOF, AS DESCRIBED IN
EXHIBIT "A" ATTACHED HERETO AND MADE A PART HEREOF, SHALL BE INCLUDED
IN ZONE OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO, AS FOLLOWS:
EXHIBIT "A" - R -1 Residential Zone
BE IT ORDAINED By the Mayor and the Council of the City
of Caldwell:
Section 1. That requests by the owners of the tracts of
land described in Exhibit "A" being attached hereto and made a part
hereof as if set forth in full, having heretofore been made to the
Council, for the annexation of said lands by the City of Caldwell,
said lands being contiguous and adjacent to the City of Caldwell,
Canyon County, State of Idaho, and the Council having consented
thereto;
Section 2. It is hereby declared by the Mayor and Council
of the City of Caldwell that the tracts of land described in Exhibit
" A " by proper legal description are hereby declared to be a part of the
City of Caldwell, Canyon County, State of Idaho. It is hereby further
declared by the Mayor and Council of the City of Caldwell that the
tracts of land described in Exhibit "A" by proper legal description
are hereby declared to be zoned as R -1 Residential Zone.
Section 3. That the full and complete legal description of
the tracts of land herein declared to be a part of the City of
Caldwell, Idaho, as hereinabove set forth are particularly set forth
in Exhibit "A ".
Section 4. That the real property described in Exhibit
"A" of this ordinance is hereby made a part of the R -1 Residential
Zone of the City of Caldwell, Idaho, and included in the boundaries

Part of the Southwest Quarter of the Northwest Quarter and part of
the Northwest Quarter of the Southwest Quarter of Section 34 and
part of the Northeast Quarter of the Southeast Quarter of Section
33, all of Township 4 North, Range 3 West of the Boise Meridian,
more particularly described as follows:
BEGINNING at the Southwest corner of the Southwest Quarter of the
Northwest Quarter of said Section 34; thence North 0 West,
660.24 feet along the West boundary of said Southwest Quarter of the
Northwest Quarter; thence North 89 27'52" East, 546.90 feet along the
North boundary of the Southwest Quarter of the Southwest Quarter of
the Northwest Quarter; thence South, 23 East, 291.06 feet;
thence South 0 East, 81.91 feet along the East boundary of
said Southwest Quarter of the Southwest Quarter of the Northwest
Quarter to the intersection of the centerline of Caldwell Low Line
Canal; thence South 22 East, 334.98 feet along the centerline
of said Low Line Canal to a point on the North boundary of the Northwest
Quarter of the Southwest Quarter of said Section 34; thence North
89 East, 534.48 feet along the North boundary of said Northwest
Quarter of the Southwest Quarter to the Northeast corner of said
Northwest Quarter of the Southwest Quarter; thence South 0 East,
1318.77 feet to the Southeast corner of said Northwest Quarter of the
Southwest Quarter; thence South 89 West, 662.22 feet along
the South boundary of said Northwest Quarter of the Southwest
Quarter; thence North 0 West, 659.86 feet; thence South
89 West, 662.08 feet to the West line of the said Northwest
Quarter of the Southwest Quarter; thence South 89 West, 364.30
feet; thence North 0 West, 330.21 feet; thence North 890 47 1 05"
East, 363.66 feet to the East boundary of the Northeast Quarter of the
Southeast Quarter of said Section 33; thence North 0 West,
330.15 feet to the POINT OF BEGINNING;
Excepting therefrom the following described property;
BEGINNING at the Northwest corner cf the Northwest Quarter of the
Southwest Quarter of said Section 34; thence South 0 East,
430.34 feet along the West line of the said Northwest Quarter of the
Southwest Quarter to the TRUE POINT OF BEGINNING; thence North 89
East, 532.03 feet; thence South 0 East, 130.00 feet;.thence South
89 West, 532.06 feet tothe West line of the said Northwest
Quarter of the Southwest Quarter; thence North 0 West, 130.00
feet along the West line of the said Northwest Quarter of the Southwest
Quarter to the TRUE POINT OF BEGINNING.
of said zone, and the City Clerk is hereby instructed to so designate
the name on the official zoning map of the City of Caldwell, Idaho.
Section 5. All ordinances, resolutions, orders, or parts
thereof in conflict herewith are hereby repealed, rescinded and
annulled.
Section 6. This ordinance shall be in full force and
effect from and after its passage, approval and publication according
to law.
Section 7. All the lands described in said ordinance shall
be subject to taxation as other property and persons within the
corporate limits of the City of Caldwell, Canyon County, Idaho,
upon filing of a certified copy of this ordinance with the County
Recorder and County Assessor of the County of Canyon, State of
Idaho, and the State Tax Commission, State of Idaho.

Notice is hereby given that a public hearing; before the Planning
and Zonin7 Commission of the City of Caldwell, Idaho, will be held
at the Council Chambers in the City Hall of said City of Caldwell
on the 16th day of February, 1978, at the hour of 7:30 o'clock
p.m., when and where any parties in interest or citizens shall
have an opportunity to be heard and present their objections, if
any, to the said Planning and Zoning Commission's proposal to
recommend the hereinafter described property to be added to the
R -1 district of the Residential zone upon annexation:
