ORDINANCE NO. 1428
AN ORDINANCE RECITING PETITION FOR VACATION AND RECITING APPROPRIATE
NOTICE THEREFOR WAS GIVEN; DETERMINING THAT VACATION OF THE FOLLOWING
DESCRIBED REAL PROPERTY SHALL BE MADE, TO -WIT:
PARCEL I : This street is situated in the City View Tracts
according to the Plat on file in Book 1 of Plats at Page 9
in the Office of the Recorder of Canyon County, Idaho and
in the SEkNE% and the NEaSE4 of Sec. 26, Tp. 4 N., Rge. 3W.B.M.
more particularly described as follows: BEGINNING at.the SE corner
of Tract 25 of said City View Tracts; thence N 0 0 07 1 20" W,
along the East boundary of said Tract 25, a distance of 253.82
feety thence S 24 °46'45" E, along a line 30.00 feet
Southwesterly of and parallel with the Southwesterly right -
of -way boundary of Interstate 80 N a distance of 119.85
feet; thence S 0 °07'20" E, along the West boundary of Tract
26 of said City View Tracts, a distance of 144.66 feet; thence
N 89 0 36'30" E, along the South boundary of said Tract 26,
a distance of 71.75 feet; thence S 24 °46'45" E, along a line
25.00 feet Southwesterly of and parallel with the South-
westerly right -of -way boundary of Interstate 80 N, a distance
of 54.88 feet; thence S 89 0 36 1 30" W. along the North boundary
of Tract 29 of said City View tracts, a distance of 449.71
feet; thence N 0 °03'20" W, along the East boundary of Tract
24 of said City View Tracts, a distance of 25.00 feet; thence
N 0 0 07 1 20" W, along the East boundary of said Tract 24, a
distance of 25.00 feet; thence N 89 °36 E, along the South
boundary of said Tract 25, a distance of 305.00 feet to the

in the SE4NE4 of Section 26; Township 4 North, Range 3 West
of the Boise Meridian and is more particularly described
as follows:
BEGINNING at the SW corner of Tract 23 of said City View Tracts;
Thence N 89 1 36 1 30" E, along the . South boundary of said
Tract 23, a distance of 423.95 feet; thence S 24 0 46'45"
E, along a line 30.00 feet Southwesterly of and parallel
with the Southwesterly right -of -way of Interstate 80 North,
a distance of 54.90 feet; thence S 89 0 36 1 30" W. along the
North boundaries of Tracts 25 and 24 of said City View
Tracts, a distance of 495.85 feet; thence N 0 ° 07'20" W, a
distance of 25.00 feet; thence N 89 ° 36'30" E, a distance of
25.00 feet; thence N 0 0 07'20" W, a distance of 25.00 feet;
thence N 89 1 36'30" E, a distance of 25.00 feet to the POINT
OF BEGINNING; This parcel contains 0.54 acre;
IS IN THE BEST PUBLIC INTEREST FOR THE CITY OF CALDWELL, IDAHO:
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
IDAHO:
ORDINANCE - 1
Section 1. That by a Resolution passed and approved by the
Mayor of the City of Caldwell, Idaho, on the 5th day of April ,
1977, and published in the NEWS - TRIBUNE, a newspaper published in
the City of Caldwell, Idaho, in two issues thereof on the 18th day
Of April , 1977 and on the 25th day of April , 1977, and stat-
utory notice having been given to citizens and owners of property
in the City of Caldwell, Idaho, that an application has been presented
to the Mayor and Council of the City of Caldwell, Idaho, requesting
the passage and approval of an ordinance vacating the above - described
real property located in Caldwell, Canyon County, Idaho, subject to
the reservations of all utility companies and all existing easement
rights in the area comprising easement rights for sewer lines, water
lines, power lines, telephone lines and gas lines as presently
located thereon or therein, with the further reservation to the City
of Caldwell, if applicable, and all utility companies with easement
rights in the area comprising said easement rights for access to and
from said area to maintain, repair or replace the present existing
sewer, water, power, telephone and gas lines as presently located
thereon or therein.
Section 2. That it is hereby determined that it is in the
best public interest that the above described premises in the City
of Caldwell, Canyon County, Idaho, be vacated, subject to existing
easement rights and further easement rights as hereinabove set forth.
Section 3. Be it ordained and established that the above
described premises in the City of Caldwell, Canyon County, Idaho, as
more particularly described above described above, sha -1 be vacated
and shall no longer be open or subject to the use of the public; and
thereupon title to said premises in the City of Caldwell, Canyon County,
Idaho, above described, shall pass and revert to the persons dedicating
the same or their successors, heirs, and assigns, subject to existing
easements in the area comprising easements for sewer lines, water lines,
power lines, telephone lines and gas lines as presently located thereon
or therein, with the further reservation to all utility companies with

easement rights in the area for access to and from said area to maintain,
repair or replace the present existing sewer, water, power, telephone
and gas lines as presently located thereon or therein. The above described
premises shall be vacated and shall pass and revert to the persons ded-
icating the same, or their successors, heirs and assigns in the manner
in which they were so dedicated.
Section 4. That all ordinances or parts of ordinances in
conflict herewith are hereby repealed.

day of May , 1977.
