ORDINANCE NO. 1427
AN ORDINANCE CHANGING THE ZONING OF CERTAIN PROPERTY WITHIN THE
CITY OF CALDWELL, IDAHO, FROM B RESIDENTIAL TO C -D COMMERCIAL ZONE
AND DETERMINING THAT SAID CHANGE IN ZONING IS IN THE BEST INTEREST
OF THE CITY OF CALDWELL, IDAHO; REPEALING ALL LAWS, ORDINANCES,
AND RESOLUTIONS IN CONFLICT HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CALDWELL, IDAHO:
WHEREAS, it has been determined by the City Council of the
City of Caldwell, Idaho, upon recommendation of the Planning and
Zoning Commission of the City of Caldwell,Idaho, that it is in the
best interests of the City of Caldwell, Idaho, that certain property
described hereafter be rezoned, it is hereby ordained as follows:
Section 1. That certain lands described in Exhibit A
attached hereto, and by this reference incorporated herein, is now
zoned B Residential, and is located within the City of Caldwell,
Canyon County, State Of Idaho, the Council having previously
annexed said lands to the City of Caldwell, Idaho.
Section 2. It is hereby declared by the Mayor and Council
of the City of Caldwell, Idaho, that the tracts of lands described
in Exhibit A, a proper legal description, to be declared to be
CB Commercial Zone property, and shall be so changed from B
Residential Zoning to C -B Commercial Zone from and after the date
of this Ordinance.
Section 3. The City Clerk of the City of Caldwell, and the
City Engineer of the City of Caldwell, are hereby instructed to
so designate the same above described property on the official
zoning map of the City of Caldwell, Idaho, as being C -D Commercial
Zone property.

Section 4. All ordinances, resolutions, orders, or parts
thereof in conflict herewith are hereby repealed, rescinded and
annulled.
Section 5. This ordinance shall be in full force and effect
from and after its passage, approval and publication according to
law.

This parcel is situated in the Northwest Quarter of the North-
west Quarter of Section 35, Township 4 North, Range 3 West of
the Boise Meridian and is nart of Tract J of 'Mountain View
Subdivision, the Plat of which is on file in Book 2 of Plats
at Page 66, in the office of the Recorder of Canyon County,
Idaho, and is more particularly described as follows:
COMMENCING at the Northeast corner of said Northwest Quarter
of the Northwest Quarter-, thence South $9 West— along
the North boundary of said Northwest Quarter of the Northwest
Quarter, a distance of 30.00 feet; thence South 0 °13 East
and parallel with the East boundary of said Northwest Quarter
of the Northwest Quarter, a distance of 25.00 feet to the TRU7
POINT OF BEGINNING-, thence continuing South 0 ° 13 1 10" East and
30.00 feet West and parallel with said East boundary, a dis-
tance of 240.00 feet; thence South 39 0 29 1 10" West, 631.51 feet;
thence North 0 1 12' west, a distance of 240.00 feet to the South
line of Linden Street; thence North 89 0 2830" East, a distance
of 631.51 feet to the TRUE POINT" OF BEGINNING.
