ORDINANCE NO. 1418
AN ORDINANCE AMENDING CHAPTER 9, TITLE 8 OF THE MUNICIPAL CODE OF
THE CITY OF CALDWELL, CANYON COUNTY, IDAHO, REGULATING STREETS AND
ALLEY CUTS AND THEIR SUBSEQUENT REPAIR: DELETING THE PRESENT LANGUAGE
REGARDING CHARGES FOR RESTORATION OF PAVED STREETS AND PAVED ALLEYS,
AND SUBSTITUTING THEREFOR A FLAT RATE CHARGE OF $35.00 FOR SAID
RESTORATION; PROVIDING EFFECTIVE DATE; REPEALING ALL LAWS INCONSISTENT
HEREWITH.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL,
CANYON COUNTY, IDAHO:
SECTION 1. That Title 8, Chapter 9, Section 2 of the
Municipal Code of the City of Caldwell, Canyon County, Idaho, be amended
by adding and deleting the following:
8 -9 -2: RESTORATION OF PAVED STREETS AND PAVED ALLEYS: Where a paved
street or alley is cut, the restoration of the pavement shall
be made by the city at the expense of the person cutting the
street or alley, and payment shall be made to the city at the
time such permit is granted. The cost restoration - shall

of restoration shall be a flat rate of THIRTY -FIVE DOLLARS
($35.00
Franchised utilities may at the approval of the Engineer
contract with others within the city to restore pavement. All
costs of pavement restoration shall be at the expense of the
utility.
SECTION 2: All ordinances or parts of ordinances incon-
sistent herewith,are hereby repealed.

effect from and after its passage, approval, and publication according to
law.
