HomeMy WebLinkAboutORD 1397M BILL NO. 29 ORDINANCE NO. 1397 By Councilman McCluskey AN ORDINANCE TO AMEND SECTION 4, CHAPTER 11, TITLE V OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, TO PROVIDE THAT MOBILE HOMES FOR WATCHMEN AND CARETAKERS MAY BE LOCATED IN ANY ZONE WITHIN THE CITY OF CALDWELL EXCEPT "A" OR "AB" RESIDENTIAL ZONES: AND PROVIDING THIS ORDINANCE TO TAKE AFFECT AFTER ITS PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1: That Section 4, Chapter 11, Title V of the Municipal Code of the City of Caldwell be amended to read as follows: 5 -11 -4: PROHIBITION OF OCCUPIED MOBILE HOMES IN CERTAIN DISTRICTS (A) Mobile homes used for residential quarters for watchmen or caretakers and located on the premises of an industrial or business establishment in any industrial zone except "A" or "AB" Residential Zone shall be permitted with approval of the City Council, provided the sanitary regulations of the Caldwell City Code are met. (B) A mobile home presently located in conjunction with a dwelling and being used for residential purposes on the effective date of this Ordinance shall be allowed to continue provided the sanitation requirements of this Section are complied with. (C) Removing the wheels or setting the mobile home on posts or footings shall not remove the mobile home from the provisions of this Ordinance. No person shall maintain two (2) or more occupied mobile homes on a single legal building site other than in a mobile home park licensed under the provisions of this Ordinance. ORDINANCE - 1 (D) All occupied mobile homes located in any districts on the effective date of this Ordinance shall be recorded by the Building Department according to the classifications listed above under subsections (A) and (B). No new license shall be issued for the continued use of a property for a mobile home site if the name of the person applying for a renewal is different than the name of the person which appeared on the license as the occupant of the mobile home on the effective date of this Ordinance. (E) A license fee of fifty dollars ($50.00) shall be obtained each year for any mobile home outside a mobile home park in accordance with the provisions of subsection (A) above. (F) If the use of the property for a mobile home site is discontinued for any reason for more than six (6) months, it shall not be re- established. (G) Mobile homes occupied or abandoned and unoccupied for a period of six (6) months may be abated if they constitute a menace to the public health, safety and welfare pursuant to the provisions of the City Code of Caldwell, Idaho. Section 2: All ordinances or part of ordinances inconsistent herewith are hereby repealed. Section 3s This ordinance shall be in full force and effect from and after its passage, approval and publication according to law. PASSED By the City Council this 7th day of September, 1976.
