AN ORDINANCE TO AMEND SECTION 3, CHAPTER 5, TITLE I OF THE
MUNICIPAL CODE OF THE CITY OF CALDWELL, COUNTY OF CANYON,
STATE OF IDAHO, TO PROVIDE THAT A COUNCILMAN`SHALL RESIGN
HIS OFFICE UPON FILING PETITION FOR NOMINATION TO OFFICE
OF THE MAYOR; AND PROVIDING THIS ORDINANCE TO TAKE AFFECT
AFTER ITS PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO
LAW.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE
CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO:
Section 1: That Section 3, Chapter 5, Title I
of the Municipal Code of the City of Caldwell be amended to
read as follows:
1 -5 -3: VACANCY; HOW FILLED: In the event an office
of Councilman shall become vacant, through death,
change of residence, or for any other cause, the
Mayor shall appoint, with the approval of the Council,
a resident of the City to fill the unexpired portion
of the term to serve until the next general election, at
which time the unexpired term shall be filled by
regular election.
In the event a Councilman shall file a
petition for nomination to the office of Mayor_, he
shall resign the office of Councilman and the Mayor
shall appoint, with the approval of the Council, a
resident of the City to fill the unexpired portion of
the term as hereinabove provided
Section 2. All ordinances or part of ordinances
inconsistent herewith are hereby repealed.
Section 3. This ordinance shall be in full force and
effect from and after its passage, approval and publication
according to law.
