HomeMy WebLinkAboutORD 1383BILL NO. 15 ORDINANCE NO. 1353 By Olesen AN ORDINANCE TO AMEND CHAPTER 3, TITLE 3, OF THE MUNICIPAL CODE OF THE CITY OF CALDWELL BY ADDING A SECTION TO BE KNOWN AS SECTION 3- 3 -25A, WHICH SAID SECTION SHALL ESTABLISH A CATEGORY OF PROPERTY OWNERS OR SEWER USERS WHICH SHALL BE KNOWN AS 01 M&JOR CONTRIBUTING INDUSTRY DEFINING "MAJOR CONTRIBUTING INDUSTRY" MAKING REFERENCE TO FEDERAL WATER POLLUTION CONTROL ACT. PROVIDING FOR A PERMIT TO BE ISSUED BY THE CITY OF CALDWELL TO MAJOR CONTRIBUTING INDUSTRIES, PROVIDING FOR SYSTEMS OF PRE - TREATMENT BY ALL MAJOR CONTRIBUTING INDUSTRIES, PROVIDING FOR A FORMULA TO BE ESTABLISHED BY THE CITY OF CALDWELL FOR A SEWER CHARGE FOR USE OF THE MUN ITAL DISCHARGE SYSTEM BY MAJOR CONTRIBUTING INDUSTRIES AND PROVIDING THAT VIOLATIONS OF THE ACT SHALL CONSTITUTE A MISDEMEANOR, AND PROVIDING THAT VIOLATIONS OF THE ACT MAY RESULT IN SUSPENSION OR REVOCATION OF THE PERMIT TO MAJOR CONTRIBUTING INDUSTRIES AND /OR PROHIBITION OF THE USE OF THE CITY SYSTEM FOR DISCHARGE OF SEWAGE BY "MAJOR CONTRIBUTING INDUSTRY PROVIDING CITY ENGINEER TO ADOPT RULES AND REGULATIONS; PROVIDING EFFECTIVE DATE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO: Section 1. That Section 3 -3 -25A of the Municpal Code of the City of Caldwell be enacted to read as follows: 3 -3 -25A: MAJOR CONTRIBUTING INDUSTRY. There is hereby established a category of any property owner or sewer user which shall be known as "major contributing industry" which will be subject to certain regulations and pre- treatment responsibilities as hereinafter promulgated. A. The definition of a "major contributing industry" is as follows: 1. has a flow of 50 000 allons or more 2er average wor ay; an 2. has a flow greater than five percent (5 %) of the low carried by the munic al s stem receivin the waste; and 3. has in its waste a toxic pollutant in toxic amounts as defined in standards issued un er Federal Water Pollution Control Act of 1 772 and its amendments; and ORDINANCE - 1 0 4. has significant impact, either singly or in combination with other contibutina industries on t o treatment works or the quality ot its effluent. B. The definition of the "Act" as hereinafter used in this chapter shall refer to the Federal Water Pollution Control Act entitled Public Law 92 -500, and its amendments of 1972. C. All major contributing industries shall be issued and comply with a permit issued by the City of Caldwell which will include allocations and limits of quality and quantity of waste loads which limits, if exceeded., shall be in violation of the ordinance and subject to its penalties. D. All major contributing industries shall have systems of pre - treatment to the degree of treatment that such wastes shall conform to the allocations of volume and quality as required by the permit and Section 307 of the "Act ". The major contributing industry shall further provide and maintain instruments to measure such flows and. proportional sampling devices provided at the industry's expense that meet the City approval which shall reasonably and accurately provide the flow data and samples for quality testing. Non - compliance to furnish and maintain this _equipment shall be considered violation of the ordinance. E. All wastes contributed to the City's eewer system, whether classified as a major contributing industry or otherwise, shall have a pH (potential hydrogen ion concentration) range between 6.0 to 9.0 at the point of discharge to the public's system. F. Each major contributing industry shall submit to the City of Caldwell, to the attention of the City Engineer, at periodic ORDINANCE - 2 0 0 intervals not to PyCeed six months, a statement in writing regarding specific actions taken to achieve full compliance with the requirements of Section 307 of the "Act ", compliance with the permit issued by the City and a narrative report of the user's activity describing the actions taken to achieve compliance with the referenced section and permit. G. A11 major contributing industries as herein defined, shall pay a monthly sewer charge as established by the City of Caldwell. The City Council shall establish a monthly charge formula based upon volume, concentration of B.O.D. and concentration of suspended solids in the liquid effluent discharged into the sewer system of the City of Caldwell by major contributing industries. H. Any violation of this Act shall constitute a misdemeanor. In addition, the City of Caldwell may suspend or revoke the permit issued to any major contributing industry and/or prohibit said industry from discharging sewage waste into the City system for repeated violation of this ordinance. I. The City Engineer is hereby authorized to adopt rules and regulations for the administration of this ordinance and the permit system herein established which rules and regulations shall be in effect upon approval by the City Council. Section 2. That this ordinance shall be in effect from and after its passage, approval and publication according to law.
