ORDINANCE NO. 1380

AN ORDINANCE DETERMINING THAT CERTAIN LAND IS CONTIGUOUS AND
ADJACENT TO THE CITY OF CALDWELL, STATE OF IDAHO, AND DECLARING
SAID LAND, BY PROPER LEGAL DESCRIPTION THEREOF, TO BE A PART OF
THE CITY OF CALDWELL, CANYON COUNTY, IDAHO; AND PROVIDING THAT
SAID REAL PROPERTY SHALL BE INCLUDED IN THE "CD" COMMERCIAL
ZONE OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO.
BE IT ORDAINED by the Mayor and Council of the
City of Caldwell:
Section 1. That request by the owner of the land
described in Exhibit "A" attached hereto and made a part hereof
as if set forth in full, having heretofore been made to the
Council, for the annexation of said land by the City of
Caldwell, said land being contiguous and adjacent to the City
of Caldwell, Canyon County, State of Idaho, and the Council having
consented thereto.
Section 2. It is hereby declared by the Mayor and
Council of the City of Caldwell that the tract of land described
in Exhibit "A" by proper legal description is hereby declared
to be a part of the City of Caldwell, Canyon County, State of
Idaho.
Section 3. That the full and complete legal description
of the tract of land herein declared to be a part of the City
of Caldwell, Idaho, as hereinabove set forth is particularly
set forth as Exhibit "A ".
Section 4. That the real property described in
Exhibit "A" of this ordinance is hereby made a part of the
"CD" Commercial Zone of the City of Caldwell, Idaho, and included
in the boundaries of said zone, and the City Clerk is hereby
instructed to so designate the same on the official zoning map

of the City of Caldwell, Idaho.
Section 5. All ordinances, resolutions, orders, or
parts thereof in conflict herewith are hereby repealed,
rescinded and annulled.
Section 6. This ordinance shall be in full force and
effect from and after its passage, approval and publication,
according to law.
Section 7. All of the lands described in said
ordinance shall be subject to taxation as other property and
persons within the corporate limits of the City of Caldwell,
Canyon County, Idaho, upon filing of a certified copy of this
ordinance with the County Recorder and County Assessor of the
County of Canyon, State of Idaho, and the State Tax Commission,
State of Idaho.
PASSED BY THE COUNCIL this 16th day of March, 1976.
EXHIBIT "A"
A parcel situated in the NW 1/4 NE 1/4 of Section 26,
Township 4 North, Range 3 West of the Boise Meridian and
more particularly described as follows:
BEGINNING at the NW corner of said NW 1/4 NE 1/4;
Thence N 89 27' 45 11 E, along the centerline of
Franklin Road, a distance of 370.12 feet;
Thence S 20 32' 15" E, a distance of 63.17 feet
to a point on the Southwesterly boundary of the
right -of -way for Ramp B -C of U.S. Highway I -80N;
Thence traversing said Southwesterly boundary of
Ramp B -C S 20 32 15" E., a distance of 51.13 feet;
Southeasterly, a distance of 258.31 feet along a
curve to the left with a radius of 370.00 feet,
a central angle of 40 00 00 and a long chord
which bears S 40 32' 15 P1 E, a distance of 253.09
feet;
S 60 32 15" E, a distance of 322.03 feet;
Southeasterly, a distance of 528.86 feet along the
arc of a curve to the right having a radius of 1016.83
feet, a central angle of 29 481 00" and a long chord
which bears S 45 38' 15" E, a distance of 522.92 feet;
Southeasterly 242.36 feet on a spiral curve to the right
with a central angle of 6 0 15' 00" and a long chord
which bears S 29 40' 37" E, a distance of 242.23
feet;
S 27 35 47 10 E, a distance of 315.34 feet to a
point on the South boundary of a dedicated unnamed
street;
Thence S 89 25' 35" W, along the South boundary of
said dedicated street, a distance of 1232.84 feet;
Thence N 0 02' 58" E, a distance of 0.54 feet to a
point on the Southerly boundary of the present
right -of -way for Access Road No. 2;
Northwesterly, a distance of 232.74 feet along the

175.00 feet, a central angle of 76 12' 00" and a
long chord which bears N 52 26' 15" W, a distance
of 215.96 feet;
