CITY OF CALDWELL, A MUNICIPAL CORPORATION OF IDAHO, DECLARING THE INTENT TO EXCHANGE THE FOLLOWING DES- CRIBED REAL PROPERTY TO LILLEY RRISCOE, CALDWELL, CANYON COUNTY, IDAHO, SAID PROPERTY BEING OWNED BY THE CITY: Commencing at the Section.corner common to Sections 15, 16, 21, and 22, Township 4 North, Range 3 West of the Boise Meridian; thence South 752 feet; thence South 46 °38' East 12 feet, to the point of beginning; thence continuing South 46 0 38' East, 52 feet thence North 43 0 22' East 136 feet; thence Northwesterly 45 feet to a point which is North. 43 0 22' East and 150 feet distant from the point of beginning; thence South 43 °22' West 150 feet to the point of beginning, containing 0.16 acres, more or less. PROVIDING THAT THE CONSIDERATION RECEIVED BY THE CITY OF CALDWELL IS ADEQUATE; PROVIDING THAT SAID EXCHANGE IS IN THE BEST INTERESTS OF THE CITY OF CALDWELL; PROVIDING THAT A PUBLIC HEARING SHALL BE HELD ON SAID PROPOSED EXCHANGE; PROVIDING THAT NO EXCHANGE SHALL OCCUR UNTIL AT LEAST SIXTY (60) DAYS HAVE EXPIRED FROM DATE OF PASSAGE AND APPROVAL OF THIS ORDINANCE; PROVIDING THAT SAID EXCHANGE SHALL BE SUBJECT TO CERTAIN TERMS AND CONDITIONS; PRO- VIDING NOTICE OF PUBLIC HEARING SHALL BE PUBLISHED; PROVIDING FOR THIS ORDINANCE TO TAKE EFFECT AFTER ITS PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW. NOW, THEREFORE, BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL OF THE CITY OF CALDWELL, A MUNICIPAL CORPORATION OF IDAHO, AS FOLLOWS: SECTION 1: Be it ordained that the City Council has determined on good cause that it is in the best interests of the City of Caldwell to exchange the following described property for property owned by Lilley Briscoe, Caldwell, Canyon County, Idaho; that the consideration for said exchange is adequate, and further hereby declaring the intent to exchange said property as hereinafter set forth: ORDINANCE - 2 Commencing at the �:ect,on. corner. co=on to Sections 15, 16, 21.,. and 22,, Township. 4. SECTION 2: That the consideration for said exchange is adequate that said exchange is in the best interests of the City of Caldwell. SECTION 3: Be it further ordained that a public hearing be held before the City Council more than sixty (60) days from the date of adoption and approval of this ordinance and that notice thereof be given. SECTION 4: That the exchange be under the following terms and conditions: A. LILLEY BRISCOE and /or her heirs at law shall not be required to sustain and /or be responsible for costs of construction and street curbs or gutters involved in the Chicago Street extension proposed by the City of Caldwell. SECTION 5: Be it further ordained that this ordinance shall be in full force and effect from and after its passage, approval and publication according to law. Said public hearing will be held at the Council Chambers, City Hall, Caldwell, Idaho, at the hour of 7:30 p.m., Marc 1 2 19 76 Said public hearing shall be held pursuant to Ordinance No. 1370 , enacted by the Caldwell City Council and approved by the Caldwell Mayor on or about January 6 , 19 76 , which said ordinance provides for real property described therein as property owned by Lilley Briscoe to be exchanged for real property described therein as property owned by the City of Caldwell.
