ORDINANCE NO. 1350 ay McCluskey AN ORDINANCE RECITING RESOLUTION GIVING NOTICE; DETERMINING THAT THE VACATION OF THE FOLLOWING DESCRIBED PROPERTY, TO -WIT: Block 1 and Block 7 of Rio Vista Acres Addition to Caldwell, Canyon County, Idaho, Gayle Lane, Gwen Lane and Elizabeth Drive, as shown on the Plat of said Rio Vista Acres in Book 6 of Plats at Page 14 in the records of Canyon County, Idaho, being; part of Government Lot 4 of Section 10 and a part of the Southeast 1/4 of the Southeast 1/4 of Section 9, all in Township 4 North, Range 3 West of the Boise Meridian, and more particularly described, to -wit: Commencing at the South 1/16 corner between said Sections 9 and 10, which is also the :Northwest corner of said Govern- ment Lot 4; thence South 43 0 03' West 41.5 feet, to the intersection of the centerlines of Ginger Lane, as shown on the Plat of said Rio Vista Acres, and Elizabeth give; thence South 3 °07' East 30.03 feet along the said centerline of Elizabeth Drive, to the South line extended of said Gin- ger Lane, the INITIAL POINT of this description; thence North 89 0 20' East 30.03 feet along the said South line ex- tended of Ginger Lane, to the Northwest corner of Lot 6 of said Block 1: thence continue North 89 0 20' East 202.4 feet, along the North line of said Block 1 to the Northeast cor- ner of Lot 5 of said Block 1; thence meandering; along, the said Westerly line of Merraton Boulevard South 4 0 20' East 445 feet, to a monument at a point of curve on the said line; thence curving to the left along the said line with the following, chords, South 4 0 44' East 80 feet, to the North- east corner of Lot 6 of said Block 7; thence South 5 0 38' East 100 feet; thence South 6 °38' East 100.1 feet; thence South 7 0 38' East 100.2 feet; thence South 8 °34' East 85 feet, to a monument at the end of the said curve; thence South 9 0 00' East 255.6 feet, along the said Westerly line of Merraton Boulevard to the Southeast corner of Lot 1 of said Block 7; thence continue South 9 0 00' East 76.4 feet, along the said line, to its intersection with the Southwesterly line of said Gwen Lane; thence North 60 0 45' West 396 feet, along the said Southwesterly line of Gwen Lane, to the Westerly line of Elizabeth Drive; thence .forth 3 ° 07' West 1038.64 feet, along the Westerly line of Elizabeth Drive, to the South line extended of Ginger Lane; thence North 89 ° 20' East 30.03 feet, along the said South line extended of Ginger Lane, to the INITIAL POINT of this description. IS IN THE PUBLIC INTEREST; PROVIDIiNG THAT THE TITLE TO SAID BLOCK 1, BLOCK 6, GAYLE LANE, GWEN LANE, AND ELIZABETH DRIVE IN RIO VISTA ACRES ADDITION TO THE CITY OF CALDWELL, CANYON COUNTY, IDAHO, AS VACATED, SHALL REVERT TO THE PERSONS DEDICATING THE SAME, THEIR SUCCESSORS, HEIRS AND ASSIGNS, SUBJECT TO ALI, UTILITY COMPANIES AND ALL EASEMENT RIGHTS IN THE AREA, IF ANY, PERTAINING TO SEWER LIJES, POWER LIgES, TELEPHONE LIgES AND GAS LINES, TOGETHER WITH ACCESS TO AND FROM SAID ARE TO MAI1NTAIN RFPAIR OR REPLACE THE SAME. 6 BE IT ORDAINED By the Mayor and Council of the City of Caldwell, Idaho: SECTION 1. That by Resolution passed by the Council and approved by the Mayor of the City of Caldwell, Idaho, on the 5th day of August, 1974, and published in the News- Tribune, a newspaper published in the City of Caldwell, Idaho, in two issues thereof on the 10th day of August, 1974, and on the 17th day of August, 1974, notice was given to citizens and owners of property in Canyon County, State of Idaho, within one mile of the boundaries of the City of Caldwell, Idaho, that an applica- tion has been presented to the Mayor and Council of the City of Caldwell, Idaho, requesting the passage and approval of an or- dinance vacating Block 1, Block 7, Gayle Lane, Gwen Lane and Elizabeth Drive in Rio Vista Acres Addition to the City of Cald- well, Canyon County, Idaho, which said lands are hereinabove desc- ribed, subject to the reservations of all utility companies and all existing easement rights in the area comprising easement rights for sewer lines, power lines, telephone lines and gas lines as presently located thereon or therein, with the further reservation to the City of Caldwell, if applicable, and all util- ity companies with easement rights in the area comprising said easement rights for access to and from said area to maintain, repair or replace the present existing sewer, power telephone and pas lines as presently located thereon or therein. SECTION 2. That it is hereby determined that it is to the best public interest that the said Block 1, Block 7, Gayle Lane, Gwen Lane, and Elizabeth Drive in Rio Vista Acres Addition to the City of Caldwell, Canyon County, Idaho, be vacated subject to existing easement rights and further easement rights as herein - above set forth. -2- SECTION 3. SECTION 4. That all ordinances or parts of ordinances in conflict herewith are hereby repealed. PASSED BY THE COUNCIL of the City of Caldwell, this 7th day of Janaa_ry _ , 1975.
