AN ORDINANCE GIVING NOTICE TO ALL CITIZENS OF THE CITY OF
CALDWELL, CANYON COUNTY, IDAHO, THAT THE MAYOR AND CITY COUNCIL
INTEND TO SELL THE FOLLOWING DESCRIBED REAL PROPERTY OWNED BY
THE CITY OF CALDWELL, CANYON COUNTY, IDAHO, AND WHICH SAID
PROPERTY IS SITUATED IN THE CITY OF CALDWELL, CANYON COUNTY,
IDAHO; THAT SAID SALE IS MADE UNDER PROVISIONS OF TITLE 50,
CHAPTER 14, IDAHO CODE; THAT SAID SALE OF SAID PROPERTY SHALL
BE AT PUBLIC AUCTION AND SHALL BE SOLD TO THE HIGHEST BIDDER
AND THAT NO BID SHALL BE ACCEPTED FOR LESS THAN THE APPRAISED
VALUE WHICH IS $ 300.00 SAID PROPERTY BEING DESCRIBED AS
FOLLOWS, TO -WIT:
Lots 17, 18, 19, 20, 21 and 22 of Block 29 to the City
of Caldwell, Idaho, according to the revised map of
Caldwell, Idaho, filed July 29, 1891, at 3:00 p.m.,
and now of record and on file in Book 1 of Plats,
Page 20, Records of Canyon County, State of Idaho.
BE IT ORDAINED AND ESTABLISHED BY THE MAYOR AND COUNCIL
OF THE CITY OF CALDWELL, CANYON COUNTY, IDAHO:
Section 1. That the Mayor and the Council of the
City of Caldwell, Idaho, hereby intend to sell at public auction
the following described real property situated within the City of
Caldwell, Canyon County, Idaho, said property being described as
follows, to -wit:
Lots 17, 18, 19, 20, 21 and 22 of Block 29 to the City
of Caldwell, Idaho, according to the revised map of
Caldwell, Idaho, filed July 29, 1891, at 3:00 p.m.,
and now of record and on file in Book 1 of Plats,
Page 20, Records of Canyon County, State of Idaho.
Section 2. That the ordinance for the sale of said
above described real property will be considered under a
suspension of the requirements that an ordinance be read on
three different days at a meeting of the Council of the City of
Caldwell, Idaho, to be held on the 4th day of February ,
1975, at the hour of eight o'clock p.m., at the Council Chambers
in the City Hall in the City of Caldwell, Idaho, when and where,
or prior to said date, any citizen of the City of Caldwell,
Idaho, or any number of citizens may express dissatisfaction
with said sale as set forth in Section 50 -1403, Idaho Code, where-
in it is provided that if a petition expressing dissatisfaction
with said sale containing the names of qualified electors of
the City in a number equal to ten percent (10 %) of the total
votes cast for mayor at the preceding city election is filed
with the City Clerk during sixty (60) days from the passage of
this ordinance, the City Council shall cause a special election
to be held on the question of whether or not the real property
shall be sold.
Section 3. The said above described property shall
be sold at public auction to the highest bidder and no bid
shall be accepted for less than the appraised price which is
300.00
$ , and the City Council may reject any and
all bids.
Section 4. Notice of the foregoing will be given to
all citizens of the City of Caldwell, Canyon County, Idaho, by
publication of this ordinance in The News- Tribune, a newspaper
published in the City of Caldwell, Idaho, in three issues thereof
published on the 7th day of December, 1974, the 14th day of
December, 1974, and the 21st day of December, 1974.
Section 5. That this ordinance shall be in force and
effect from and after its passage, approval and publication.
PASSED By the Council this 3rd day of December,
1974.
APPROVED By the Mayor this 3rd day of December,
1974.
