AN ORDINANCE TO AMEND TITLE 3, CHAPTER 3, OF THE MUNICIPAL
CODE OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE OF
IDAHO, BY ADDING A NEW SECTION TO BE KNOWN AND DESIGNATED
AS TITLE 3 CHAPTER 3, SECTION 30, PROHIBITING THE USE OF
OUTSIDE TOILETS AND PRIVIES; DECLARING THE SAME A NUISANCE
AND AGAINST PUBLIC HEALTH; PROVIDING FOR TEMPORARY OUTSIDE
TOILETS; AND PROVIDING FOR THIS ORDINANCE TO TAKE EFFECT
AFTER ITS PASSAGE, APPROVAL AND PUBLICATION ACCORDING TO LAW.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY
OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, THAT:
SECTION 1: That Title 3, Chapter 3, Section 30,
of the Ordinance of the Municipal Code of the City of
Caldwell, be enacted to read as follows:
3 -3 -30: USE OF OUTSIDE TOILETS AND PRIVIES:
(A) It shall be unlawful and constitute a misdemeanor for
any person to use or permit the use of, on any premises
owned, occupied or used by them, of any outside toilet
or privy within the limits of the City of Caldwell,
County of Canyon, State of Idaho.
(B) The use of any outside toilet or privy within the limits
of the City of Caldwell, County of Canyon, State of Idaho,
is hereby declared to be against public health and a
public nuisance.

(C) Each day this ordinance is violated by any person shall
constitute a separate offense.
(D) Provided, however, that the building official may grant
permits for the temporary use of temporary outside toilets
and the operation and use of said toilets, pursuant to
said permit, shall not be unlawful.
SECTION 2: That all ordinances or parts of ordinances

in conflict herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force
and effect from and after its passage, approval and publication
according to law.
