AN ORDINANCE TO AMEND TITLE 3, CHAPTER 3, SECTION 25,
SUBSECTION D, BY ADDING A PROVISION ESTABLISHING THE
CONSTRUCTION CHARGE OF SIX HUNDRED DOLLARS ($600.00)
FOR SEWER CONNECTION FOR EACH MOBILE HOME NOT IN A
MOBILE HOME COURT; REPEALING ALL ORDINANCES OR PARTS
OF ORDINANCES IN CONFLICT HEREWITH; AND PROVIDING
FOR THIS ORDINANCE TO TAKE EFFECT AFTER ITS PASSAGE,
APPROVAL AND PUBLICATION ACCORDING TO LAW.
BE IT ORDAINED BY THE MAYOR AND CITY COUNCIL
OF THE CITY OF CALDWELL, A MUNICIPAL CORPORATION OF IDAHO,
AS FOLLOWS:
SECTION l: That Title 3, Chapter 3, Section 25,
Subsection D. of the Ordinance of the Municipal Code of the
City of Caldwell, be amended to read. as follows:
3 -3 -25: SEWER SERVICE CHARGE RATES: There is hereby levied
and imposed on all users of the City sewer system, for
use, maintenance, operation, extension and reconstruction of the
Municipal sewage facilities consisting of interceptor sewer lines
and sewage treatment plant charges per month established as
follows:
(A) Sewer charges for buildings constructed for the use of
dwellings, the basis monthly sewer charge for each such
building shall be one dollar ($1.00) and a monthly charge
equal to sixty per cent (60 %) of the average charge made
to such buildings for the months of December, January and
February immediately preceding. Provided, however, that
the monthly water charge for said months of December,
January and February immediately preceding shall be reduced
by fifty cents (50e). Where any building was not receiving
water and water service for such preceding three (3) months,
it shall be assumed that the water, bill for each of said
preceding months would have been the minimum monthly charge
then in effect.
(B) For buildings constructed for use for commercial purposes,
the basic monthly sewer charge for each such building
shall be one dollar ($1.00) and a monthly charge equal to
seventy five per cent (75 %) of the current monthly water
charge. For the purpose of determining the sewer service
charge, the monthly water charge shall be reduced by fifty
cents (500). The sewer service charge shall be seventy
five per cent (75 %) of the current monthly water charge
after the above stated adjustment has been made.

(C) Providing further that fifty cents (50, of each of the
basic one dollar ($1.00) charges made in subsections (A)
and (B) above shall be designated and used exclusively
for the improvement of the City of Caldwell sewer system..
Prorated monthly assessments may be made as provided in
Title 3, Chapter 3, Section 28 of the Caldwell City Code.
For all structures not coming within either of the above
classifications, including such structures as those presently

used by Dairymen's Cooperative Creamery of -Boise .Valley and
the Idaho Meat Packers, and for structures to which water is
supplied from sources other than the Municipally owned wager
system, sewer charges shall be fixed in such amounts as may
be recommended by the City Engineer and approved by the City
Council.
(D) Sewer Construction Charge Rates. There is hereby established
a construction charge of six hundred dollars ($600.00) for
sewer connection for each single family residence and for
each mobile.home not in a mobile home court and a sewer
construction charge of three hundred dollars ($300.00) for
each apartment of a multiple living unit and three hundred
dollars ($300.00) for each mobile home in a mobile home
court.
(E) Sewer Construction Charges for Commercial Usage. There is
hereby established a sewer construction charge for commercial
usage based as follows:
1. Six hundred dollars ($600.00) for a business that
employs up to and including ten (10) employees. There
shall be an additional charge of five dollars ($5.00) for
each employee in excess of ten (10) employees.
(F) Payment required in subsections (D) and (E) will be made
as follows, to wit:
1. Prior to the issuance of any plumbing permit required
by the City of Caldwell, Idaho, where sewer facilities

are available; or
2. Within six (6) months from the time sewer services
become available.
(G) The charges set forth in subsections (D) and (E) above shall
be reviewed annually by the Mayor and City Council.
(H) Payments required in subsections (D) and (E) above shall
be made to the City Clerk of the City of Caldwell, Idaho,
or by participation in a Local Improvement District as
provided by Title 50, Chapter 17, Idaho Code as amended.
(I) All moneys received from charges set forth in subsections
(D) and (E) shall be used in the extension of the sanitary
system of the City of Caldwell.
(J) It is hereby provided that all properties that have parti-
cipated in the cost of providing a City maintained sewer
main or lateral will be exempted from provisions of sub-
sections (D) and (E).
(K) The provisions of subsections (D) through (J) shall not
apply to areas numbered 1 and 2 as shown on the official
Sewer Map of the City of Caldwell, Idaho, on file in the
City Clerk's office of the City of Caldwell, Idaho.
SECTION 2: This Ordinance shall be in full force and
effect from and after its passage, approval and publication

according to law.
SECTION 3: That all ordinances or parts of ordinances
in conflict herewith are hereby repealed.
PASSED BY THE COUNCIL of the City of Caldwell this
