AN ORDINANCE TO AMEND TITLE 4, CHAPTER 7, SECTION 4(e) OF THE
MUNICIPAL CODE OF THE CITY OF CALDWELL, COUNTY OF CANYON, STATE
OF IDAHO, BY PROVIDING THAT THE METHOD OF MEASURING THE DISTANCE
BETWEEN A LICENSED PREMISE AND A CHURCH, SCHOOL OR COLLEGE SHALL
BE FROM BUILDING TO BUILDING AND TO CHANGE THE DISTANCE FROM
SIX HUNDRED (600 FEET TO THREE HUNDRED (300') FEET, AS SET
FORTH BY THE STATE OF IDAHO.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY
OF CALDWELL, IDAHO:
SECTION 1. That Title 4, Chapter 7, Section 4(c)
of the Municipal Code of the City of Caldwell, be amended to
read as follows:
4 -7 -4: CONDITIONS OF LICENSE:
(A) The license fee shall permit the sale of such beer in but
one (1) place of business. Such place of business to be
designated in the license issued.
(B) All licneses shall be issued by the Clerk.
(C) The Mayor and Council may grant to any person theretofore
procuring a license to sell beer as herein provided, a
license provided for the class next above the license of
said licensee upon his paying to the Clerk the difference
between the license for which he has already paid and the
license which he seeks.

(D) It shall be the duty of the licensee to keep posted in a
conspicuous place, in the place of business for which the
license is granted, such license.
(C) No license shall be granted to a person who is not of
good moral character and who is under the age of nineteen
(19) years, or to a person to sell or dispose of beer by

issued for any premises within three hundred feet (300')
of any public school, church or other place of worship, or
college, measured in a straight line from said building to
the nearest entrance of the licensed premises.
Provided, however, a license shall be granted to a place
of business in the P or "B" Residential Zone for the
retailing of bottled beer or canned beer, none of which
is to be consumed on the premises, with the approval, in
writing of seventy five percent (75 %) of the property owners
within a radius of three hundred feet (300') from the
established property line of the premises whereupon beer

is to be sold. This ordinance shall in no way alter,
amend, or repeal any of the provisions of Title VI,
Chapter 3, subsection (B) of this Code for erecting or
occupying a retail business in the "A" or "B" Residential
Zone.
This amendment shall in no way affect premises licensed as
of the date of the passage of this amendment to ordinance.
PASSED BY THE COUNCIL of the City of Caldwell, this
3rd day of September, 1 974.
