AN ORDINANCE TO AMEND CHAPTER 13, TITLE 11, OF THE CITY
CODE OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, BY
ADDING A NEW SECTION TO ENTITLED SECTION 11- 13 -12, TO
PROVIDE AUTHORITY FOR THE CHIEF OF POLICE TO ESTABLISH
PARKING ZONES WITH TIME LIMITS WITHIN THE STREETS OF
THE CITY OF CALDWELL AND TO PROVIDE AUTHORITY WITHIN
THE CHIEF OF POLICE, CITY OF CALDWELL, TO LIMIT THE
CLASS OF VEHICLES WHICH MAY PARK ON THE STREETS OF THE
CITY OF CALDWELL IN THE BUSINESS SECTION TO THOSE VEHICLES
IN WHICH THE OCCUPANTS OR DRIVER ARE ENGAGED IN COMMERCIAL
BUSINESS.
WHEREAS, Heavy traffic congestion within the
business districts and on the business streets of the City
of Caldwell have caused extreme loss and inconvenience to
the general public and residents of the City of Caldwell;
and
WHEREAS, The traffic congestion requires regulation
of traffic and parking on the streets of the City of Caldwell;
NOW, THEREFORE:
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE
CITY OF CALDWELL, COUNTY OF CANYON, STATE OF IDAHO, THAT:
SECTION 1: That Chapter 13, Title 11, of the
Ordinance of the Municipal Code of the City of Caldwell be,
amended by adding a Section to be designated Section 11 -13 -12
to read as follows:
11- 13 -12• PARKING REGULATIONS. The Chief of Police is hereby
authorized to determine and designate by prope signs
areas streets, or parts of streets, in which parki shall be

limited by time in any area or street within the City of
Caldwell in which he determines to be congested.
The Chief of Police is further authorized to
determine and designate by proper signs, areas, streets or
parts of streets in which parking shall be limited to vehicles
engaged in commercial business.
Vehicles engaged in commercial business as used
herein shall mean vehicles used for the purpose of loading
or unloading goods and /or merchandise at businesses adjacent
to or in close proximity to the loading zone and /or vehicles
in which the driver and /or occupants are engaged in patronizing
businesses adjacent to or in close proximity of the parked
vehicle.
Before the Chief of Police shall designate any
area, street or part of street as an area in which parking
shall be limited in either time or to vehicles engaged in
commercial business, the Chief of Police shall secure approval
of the City Council.
Before said time limit or commercial vehicle limitation
shall be imposed, it shall be the duty of the Chief of Police
to erect appropriate signs giving notice thereof in di c ating
such limitations or prohibitions.
Enforcement of the parking restrictions herein
authorized shall be as set forth in Section 11 -13 -9.
Provided, however, that each owner or operator
may within twenty -four (24) hours of the time of notice of
violation as provided in Section 11 -13 -9, pay to the P olice
Department as a penalty for, and in full satisfaction of any
violation, the amount of Five Dollars ($5.00) for each hour

or fraction thereof, that such vehicle was parked in violation
of the parking time limit or commercial vehicle limitation as
established by the Chief of Police.
SECTION 2: That all ordinances or parts of ordinances
in conflict herewith are hereby repealed.
SECTION 3: This ordinance shall be in full force and
effect from and after its passage, approval and publication
according to law.
PASSED BY THE COUNCIL of the City of Caldwell this
